Hadith 19625
١٩٦٢٥ - حدثنا أبو بكر قال: نا عبد اللَّه بن نمير عن حنظلة قال: سمعت القاسم ابن محمد وسئل عن الإيلاء قال: يوقف فيقال للذي يسأله: هل طلقت؟ قال: (لا) (١) ولكن يدعو الإمام فإما أن يفيء وإما أن يفارق.
Hazrat Hanzalah (may Allah have mercy on him) says that Hazrat Qasim bin Muhammad (may Allah have mercy on him) was asked about Ilaa: Will the decision of Ilaa depend on the one who swears (the husband), that he will be asked? He replied: No, rather the Imam will summon him, and then in his presence, if he wishes, he may reconcile, and if he wishes, he may divorce.
