ما قالوا في الخلع يكون دون السلطان؟Can Khul Be Done Without the Sultan's Intervention?
Hadith 19501
١٩٥٠١ - حدثنا أبو بكر قال: نا وكيع عن شعبة عن الحكم عن خيثمة قال: أتى (بشر) (١) بن مروان في خلع كان بين رجل و (امرأة) (٢) فلم (يجزه) (٣)، فقال له عبد اللَّه ابن (شهاب) (٤) الخولاني: شهدت عمر بن الخطاب أتي في خلع كان بين ⦗٢٨٠⦘ رجل وامرأته فأجازه (٥).
Hazrat Khaythamah (may Allah have mercy on him) says that a case of khula (divorce initiated by the wife) between a husband and wife was brought before Bishr bin Marwan. Bishr did not permit it. Then Hazrat Abdullah bin Shahab Khawlani (may Allah have mercy on him) said to Bishr, "I was present with Hazrat Umar bin Khattab (may Allah be pleased with him) when a case of khula was brought before him, and he permitted it."
