Hadith 19449
١٩٤٤٩ - حدثنا أبو بكر قال: حدثنا ابن عليه عن ابن جريج قال: كان طاوس يقول: يحل له الفداء (ما) (١) قال اللَّه: ﴿إِلَّا أَنْ يَخَافَا أَلَّا يُقِيمَا حُدُودَ اللَّهِ﴾، ولم يكن يقول قول السفهاء: حتى تقول: لا أغتسل لك من جنابة، ولكنه كان يقول: ﴿إِلَّا (أَنْ) (٢) (يَخَافَا) (٣) أَلَّا يُقِيمَا حُدُودَ اللَّهِ﴾ [البقرة: ٢٢٩] فيما افترض لكل واحد منهما على صاحبه في العشرة والصحبة.
Hazrat Ibn Jurayj (may Allah have mercy on him) says that Hazrat Tawus (may Allah have mercy on him) used to say that compensation (fidyah) in khula is only valid as long as both fear that they will not be able to uphold the limits set by Allah. It is not valid merely on the basis that the woman says, "I will not perform the ritual bath (ghusl) of impurity for you." Rather, the real basis is the inability to uphold the limits set by Allah. The limits set by Allah are prescribed for both, such as good treatment and companionship.
