١٩٤٣٩ - حدثنا أبو بكر قال: نا جرير عن مغيرة عن (إبراهيم) (١) قال: لا يحل له أن يأخذ (فدية) (٢) من امرأته (إلا أن لا) (٣) تطيعه ولا تبر له قسمًا فإن فعلت ذلك ⦗٢٦٧⦘ فكان من قبلها شيء حلت له الفدية، فإن أبي أن يقبل منها الفدية وأبت أن تطيعه بعثا حكمين، حكمًا من أهله وحكمًا من أهلها.
Ibrahim (may Allah have mercy on him) says that it is not permissible for a man to take compensation for khul‘ (divorce at the wife’s request) from his wife merely because she does not obey him or does not fulfill his oath; however, if he does so, then the compensation is lawful for him. If the husband refuses to accept the compensation and the woman refuses to obey, then two men should be appointed for judgment—one from the woman’s family and one from the man’s family.
