Question:
When there is no agreement between husband and wife, and fighting is a norm, what is the ruling?
Answer:
If there is continuous disagreement between the spouses, and no possibility of agreement is seen, then the husband should give the wife a divorce; therein lies the welfare of both this world and the Hereafter. Allah Almighty has said:
﴿فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَانٍ﴾
Reference: (Al-Baqarah: 229)
"Keep the wife in a good manner or release her with kindness."
This means either to keep her with goodness and kindness or to let her go with kindness. Living a life filled with fighting and hatred is not better for the husband, nor for the wife, nor for the children.
