The Sharʿī Ruling on Sufism and Taking Bayʿah (Allegiance)

❖ Question​


Is it permissible to take Bayʿah (allegiance) at the hands of a Sufi or religious scholar, and to follow the path of Sufism (Taṣawwuf)?

❖ Answer​


From a Sharʿī perspective, Bayʿah is only legislated for the Caliph (Khalīfah) or Imam of the Muslims. The act of giving Bayʿah to a ruler is the responsibility of Ahl al-Ḥall wa al-ʿAqd—that is, respected scholars, jurists, and government authorities. Their consensus affirms the legitimacy of the ruler’s authority.


While common Muslims are not required to individually give Bayʿah, they are obligated to obey the appointed Khalīfah in all that aligns with the obedience of Allah.

❖ Statement of Imam al-Māwardī​


Imam al-Māwardī said:


"The Bayʿah of the Ahl al-Ḥall wa al-ʿAqd is sufficient for the appointment of the Imam. It is not necessary for all individuals to physically give their hands in allegiance. Mere obedience and refraining from opposition is sufficient."

❖ The Sharʿī Nature of Bayʿah​


When Bayʿah is mentioned in Hadith, it refers specifically to the Bayʿah given to the ruler or Imam. It does not pertain to Bayʿah taken by various individuals, sects, or groups.


Shaykh Ṣāliḥ al-Fawzān stated:


"Bayʿah is solely for the legitimate Muslim ruler (Walī al-Amr). All other forms of Bayʿah are innovations. These multiple Bayʿahs lead to division and disunity. It is obligatory upon Muslims to unite under one Imam, and multiple Bayʿahs are impermissible."

❖ The Status of Sufi Orders in Sharīʿah​


In the present age, the practice of taking Bayʿah in various Sufi orders has no basis in the Sharīʿah. These practices are not supported by evidence from the Qur’an or authentic Sunnah.


Hence, it is advised to refrain from such practices. Muslims should make the Qur’an and Sunnah the center of their lives and avoid innovations (bidʿah).

Conclusion​


It is not permissible in Sharīʿah to give Bayʿah to any Sufi or group. The command for Bayʿah applies exclusively to the legitimate Khalīfah or Imam of the Muslims. Practices outside of this, such as Sufi allegiances, fall into the realm of innovation and must be avoided.
