The Ruling on Not Executing a Bequest

It is obligatory upon the guardian (trustee) to ensure that the lawful bequest is executed. If the executor (the one to whom the bequest was made) fails to implement the bequest or causes any deficiency in its execution, then the responsibility will fall upon the guardian. Allah (ﷻ) says:

«فَمَن بَدَّلَهُ بَعْدَ مَا سَمِعَهُ فَإِنَّمَا إِثْمُهُ عَلَى الَّذِينَ يُبَدِّلُونَهُ ۚ إِنَّ اللَّهَ سَمِيعٌ عَلِيمٌ» [البقرة: 181]

“Then whoever changes it after he has heard it, the sin is only upon those who change it. Indeed, Allah is All-Hearing, All-Knowing.”
