The Hadd Punishment for Zina and the Legal Standing of Modern Scientific Evidence

❖ Establishing the Hadd for Zina Through Modern Means​


It is not valid to establish the crime of zina using modern scientific means such as DNA testing, fingerprint reports, or circumstantial evidence (e.g., being found at the scene). These tools may indicate presence or physical contact, but they merely suggest possibility and suspicion, and thus are insufficient to definitively prove the crime that warrants the enforcement of Hadd on both individuals involved.


Such evidence is also not sufficient to exempt a person from the Hadd of Qadhf (false accusation of zina) if he accuses a chaste man or woman of zina without producing four witnesses. Allah (سبحانه وتعالى) is All-Knowing and Most Merciful toward His servants.


Despite the existence of these modern methods, anyone who accuses a chaste woman without presenting four witnesses is to be subjected to the Hadd of Qadhf, as commanded by Allah. In His legislation, Allah is All-Knowing and All-Wise.


If there were any means apart from four eyewitnesses that could remove the Hadd for slander or prove zina definitively, Allah would have revealed it in His Book or through revelation to His Prophet (صلى الله عليه وسلم). And your Lord does not forget:
«وَمَا كَانَ رَبُّكَ نَسِيًّا»


One who possesses insight into the wisdom and legislative intent of Allah will not fail to grasp the wisdom behind the Hadd for slander. It serves to:


Prevent the spread of immorality
Preserve honor and dignity
Close the doors to enmity and hostility


Because of the serious nature of this crime, Allah has not accepted fewer than four eyewitnesses, and indeed, He is All-Knowing and All-Wise.
