❖ Scholarly and Legal Review of the Killing of Kaʿb ibn al-Ashraf

❖ The Question

Was the assassination of Kaʿb ibn al-Ashraf, ordered by the Prophet ﷺ, historically authentic and legally valid in Islam?

This question arises due to objections raised by modernist circles, particularly the “Tulu‘-e-Islam” publication from Delhi, which declared the incident fabricated and immoral, suggesting that it was invented by later dynasties to justify political killings.

✿ Historical Authenticity of the Incident

The event is recorded in the most authentic and primary Islamic sources, including:

Ṣaḥīḥ al-Bukhārī
(Kitāb al-Maghāzī – Bāb Qatl Kaʿb ibn al-Ashraf)
Ṣaḥīḥ Muslim
(Kitāb al-Jihād wa al-Siyar – Bāb Qatl Kaʿb ibn al-Ashraf Ṭāghūt al-Yahūd)
Fatḥ al-Bārī, Sīrat Ḥalabiyyah, Ibn Hishām, Ṭabaqāt Ibn Saʿd, Abu Dawood, Tirmidhī, and others.

→ The chain of narration and the content are both sound (ṣaḥīḥ) and established in mainstream Hadith sciences.

✿ Brief Summary of the Incident

Date: Rabīʿ al-Awwal, 3 AH

Who was Kaʿb ibn al-Ashraf?
A Jewish poet and the son of the chief of the Ṭayy tribe, Kaʿb was a master conspirator, known for:

Violating treaties with the Muslims
Inciting Quraysh and other tribes against the Prophet ﷺ
Composing satirical and insulting poetry against the Prophet ﷺ and Muslim women
◈ Attempting to incite murder plots against the Prophet ﷺ
◈ Actively participating in psychological warfare through poetry and propaganda

✿ The Prophet’s ﷺ Action

The Prophet ﷺ said:

"Who will relieve me from Kaʿb ibn al-Ashraf?"
Upon this, Muḥammad bin Maslamah (RA) volunteered and was permitted to use strategic deception. With a carefully planned approach, he and his companions executed the assassination without harming innocents.

✿ Sharʿī Basis and Justification

Violation of Treaty: Kaʿb breached the terms of peace made with the Muslims.
War Crimes: He played a pivotal role in hostile incitement, which under Islamic law justifies capital punishment.
No Collateral Damage: The assassination was targeted and surgical, not a mass killing.
Preserving Public Safety: Eliminating the root instigator of sedition is a principle of Prophetic statecraft.

"Indeed, fitnah (sedition) is worse than killing."
[Surah al-Baqarah: 217]

✿ Response to Modern Objections

❖ Objection: This narrative is fabricated

Answer: The incident is in Ṣaḥīḥ al-Bukhārī and Ṣaḥīḥ Muslim, which are the most rigorously authenticated Hadith collections in Islam.
Denying it solely based on subjective reasoning is a rejection of the foundational Hadith sciences.

❖ Objection: This act is against the Prophetic character

Answer: The Prophet ﷺ is the embodiment of mercy, but also a head of state entrusted with ensuring justice and public safety.
Islamically, treachery and incitement to murder are punishable, especially when repeated and dangerous.

❖ Objection: Deception was used; is that ethical?

Answer: Strategic deception in warfare and security matters is permissible and even necessary. The Prophet ﷺ himself said:

"الحرب خدعة" – War is deception."
[Ṣaḥīḥ al-Bukhārī]

When dealing with serious threats, preventive, targeted measures are fully within the bounds of Islamic governance.

✿ Legal Principle in Islamic Governance

The Prophet ﷺ, as both Messenger and statesman, took measured actions against those who posed existential threats to the Muslim community.

The Sharʿī framework of Islam allows for:

Targeted retaliation against proven sedition
Preventive measures when fitnah endangers the safety of the community
Maintaining treaties only with those who uphold them

✅ Summary and Conclusion

The assassination of Kaʿb ibn al-Ashraf is historically and religiously authentic, supported by the Ṣaḥīḥayn and other reliable sources.
✔ His consistent betrayal, mockery, and calls for violence made him a legitimate target under Islamic law.
The Prophet ﷺ’s action was legal, just, and strategic, not emotional or vengeful.
Modern objections to the incident stem from a lack of understanding of Islamic legal principles and misinterpretation of Prophetic mercy.
