Selling the Hide of Carrion or Jhatkā Before Tanning is Impermissible

❖ Question
Is it permissible to buy and sell the hide of carrion (dead animal) or jhatkā (animal slaughtered without Shar‘ī method)?
❖ Answer
Al-ḥamdu lillāh, waṣ-ṣalātu was-salāmu ʿalā Rasūlillāh, ammā ba‘d!
- The Shar‘ī ruling concerning the hides of carrion or jhatkā is:
✿ Before tanning (dabāghah), their buying and selling is impermissible and prohibited.
✿ After tanning, their buying and selling is permissible and valid.
❖ Evidence from Ḥadīth
ʿAbdullāh ibn ʿAbbās (رضي الله عنهما) narrated:
"عَنِ ابْنِ عَبَّاسٍ، قَالَ: تُصُدِّقَ عَلَى مَوْلَاةٍ لِمَيْمُونَةَ بِشَاةٍ فَمَاتَتْ فَمَرَّ بِهَا رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «هَلَّا أَخَذْتُمْ إِهَابَهَا فَدَبَغْتُمُوهُ فَانْتَفَعْتُمْ بِهِ؟» فَقَالُوا: إِنَّهَا مَيْتَةٌ فَقَالَ: «إِنَّمَا حَرُمَ أَكْلُهَا»"
(Ṣaḥīḥ Muslim, Kitāb al-Ḥayḍ, Bāb Ṭahārat Julūd al-Mayyitah bi al-Dibāgh, Ḥadīth 363, 1/277)
This ḥadīth makes it clear that eating the flesh of a dead animal is prohibited, but after tanning its hide, it becomes permissible to benefit from it — whether through usage or buying and selling.
❖ Fatwa of Shaykh al-Ḥadīth Mubārakpūrī (رحمه الله)
- Before tanning: buying and selling is impermissible and prohibited.
- After tanning: buying and selling is permissible and correct.
