Is the Husband Obligated to Pay for His Wife’s Travel Expenses?
Source: Ahkam wa Masail, Vol. 01, in the light of the Qur’an
❖ Question
A woman’s parents live abroad. To resolve visa issues, they have called their daughter to visit them. The problem is that her husband refuses to pay for the outgoing travel ticket, though he is willing to cover the return ticket. The question is: Does Sharīʿah obligate the husband to cover both sides of the travel expenses?
❖ Answer
Al-ḥamdu lillāh, waṣ-ṣalātu wa-salāmu ʿalā Rasūlillāh, ʿAmma Baʿd!
✿ Husband’s Obligatory Financial Duty
According to Islamic law, the husband’s obligatory financial responsibility (nafaqah wājibah) includes only:
- Food
- Clothing
- Residence
Beyond these essential needs, other expenses are not obligatory unless they were explicitly stipulated at the time of marriage.
✿ If Travel Expenses Were a Condition in Nikah
- If, at the time of marriage, it was clearly stipulated that the husband would cover his wife’s travel expenses,
- Then the husband is bound by Sharīʿah to fulfill this condition.
✿ If No Condition Was Made
- If no such agreement was made at marriage,
- Then the husband is not legally obliged to cover the wife’s two-way ticket expenses.
✿ Ethical Aspect
- If the husband is financially able, it is more appropriate for him to act with kindness and avoid disputes.
- Spending on one’s wife and children according to one’s means is not only a duty of care but also considered by the Prophet ﷺ as among the best forms of charity:
“Spending on one’s family is the best charity.” (Hadith of the Prophet ﷺ)
