Sharʿī Ruling on Eating Jhaṭkā or Meat Slaughtered by Hindus: Muslim or Kāfir?

Question:​


A person eats jhaṭkā (animal slaughtered without invoking Allah’s name, in one blow) or the meat slaughtered by a Hindu.


  • Does he remain a Muslim or become a kāfir?
  • Is he liable to ḥadd or taʿzīr punishment?
  • Must he recite the kalimah again?

Answer:​


Al-ḥamdu lillāh, waṣ-ṣalātu wa-s-salāmu ʿalā Rasūlillāh, ammā baʿd!


Hindu Slaughter (Jhaṭkā) in Sharīʿah​


◈ The meat slaughtered by Hindus or through jhaṭkā is ḥarām for Muslims.
◈ In Sharīʿah, such meat is regarded as maytah (carrion).


Qurʾānic Evidences​


Allah ﷻ says:


﴿حُرِّمَتْ عَلَيْكُمُ الْمَيْتَةُ﴾ (al-Māʾidah: 3)
"Forbidden to you is carrion."


And:
﴿وَلَا تَأْكُلُوا مِمَّا لَمْ يُذْكَرِ اسْمُ اللَّهِ عَلَيْهِ وَإِنَّهُ لَفِسْقٌ﴾ (al-Anʿām: 121)
"And do not eat from that upon which Allah’s name has not been mentioned, for indeed it is grave disobedience."


Ruling on the Person Who Eats It​


◈ A person who eats jhaṭkā or Hindu-slaughtered meat remains a Muslim; he does not become a kāfir.
◈ There is no need for him to recite the kalimah again.
◈ However, he must repent sincerely from eating ḥarām.
◈ Other Muslims should kindly but firmly advise and prevent him from repeating this act.


Punishment in Sharīʿah​


◈ There is no evidence for applying ḥadd or taʿzīr punishment on such a person.
◈ The correct course is only tawbah and correction.
