❖ Question:​


If a woman performs Hajj without a maḥram, will her Hajj be valid? Can a mentally mature child serve as a maḥram? And what are the sharʿī conditions for someone to be considered a maḥram?


❖ Answer:​


Al-ḥamdu lillāh, waṣ-ṣalātu was-salāmu ʿalā Rasūlillāh. Ammā baʿd:


Although a woman’s Hajj performed without a maḥram is technically valid, it is ḥarām (forbidden) and prohibited for her to travel for Hajj or any long journey without a maḥram. This is in clear violation of the command of Rasūlullāh ﷺ, who said:


«لَا تُسَافِرِ اْمَرْاةٍَ إِلَّا مَعَ ذِی مَحْرَمٍ»
(Ṣaḥīḥ al-Bukhārī, Kitāb Jazāʾ aṣ-Ṣayd, Bāb Ḥajj an-Nisāʾ, Ḥadīth: 1862 / Ṣaḥīḥ Muslim, Kitāb al-Ḥajj, Bāb: Safar al-Marʾah maʿa Maḥram ilā al-Ḥajj wa Ghayrihi, Ḥadīth: 1341)


Translation:
"A woman must not travel without a maḥram."


❖ A Minor Child Cannot Be a Maḥram​


✔ A minor (underage) boy cannot serve as a maḥram, as he himself is in need of care and supervision.
✔ Such a child is incapable of providing protection and thus does not fulfill the role of a sharʿī maḥram.


Sharʿī Conditions for Someone to Be a Maḥram


A person must meet the following conditions to qualify as a sharʿī maḥram:


He must be a Muslim
He must be male
He must be an adult (bāligh)
He must be sane and mentally sound (ʿāqil)


Anyone who does not fulfill these conditions cannot be considered a sharʿī maḥram.


Women Traveling by Air Without a Maḥram – A Dangerous Practice


It is deeply concerning that some women consider air travel without a maḥram as trivial and seek to justify it with statements like:


“My maḥram dropped me at the airport.”
“Another maḥram will receive me at the destination.”
“There is no danger inside the aircraft.”


But these justifications are invalid because:


➊ A maḥram cannot accompany her beyond the airport lounge — he is not present during the flight.
Flight delays can leave the woman alone and unaccompanied.
➌ Sometimes the aircraft lands at an alternate airport, and the woman may become lost or stranded.
➍ The receiving maḥram may fail to arrive due to illness, delay, accident, or other unforeseen circumstances.
➎ Even if everything goes smoothly, there remains the serious risk that a man sitting next to her may not fear Allah and might mislead her — a cause of fitnah and corruption, as proven by many real-life incidents.


Sharʿī Responsibility of the Woman and Her Guardians


✔ The woman must fear Allah and never travel without a maḥram.
✔ Her guardians and family members must also:


Fear Allah,
Take the protection of maḥram women seriously,
Avoid negligence in matters of religion and honor.


On the Day of Judgement, a person will be questioned about his household, for they are his responsibility.


Clear Guidance from the Noble Qur’an


﴿يـأَيُّهَا الَّذينَ آمَنوا قوا أَنفُسَكُم وَأَهليكُم نارًا وَقودُهَا النّاسُ وَالحِجارَةُ...﴾
(Sūrah at-Taḥrīm, Āyah 6)


Translation:
"O you who believe! Save yourselves and your families from a Fire whose fuel is people and stones, over which are appointed stern and severe angels who do not disobey Allah in what He commands them and who do as they are ordered."
