Ruling on Unauthorized Sale (Bayʿ al-Fuḍūlī)

Bayʿ al-Fuḍūlī refers to selling someone’s property without their permission. This type of sale is permissible only if the owner later approves it; if the owner, after coming to know of it, accepts and keeps the transaction, it is valid — otherwise, it is not.


Imām Mālik, Imām Aḥmad, and the Ḥanafī scholars all hold this opinion.
