Ruling and Jurisprudential Guidance on Making Up the Sunnah of Fajr after Fard

Question:
If someone could not perform the Sunnah prayer of Fajr before the Fard prayer, can he perform them after the Fard prayer? Does the prohibition of performing voluntary prayers after Fajr apply to this case or not?


Answer:
Al-ḥamdu lillāh, waṣ-ṣalātu wa-s-salāmu ʿalā Rasūlillāh, Ammā baʿd:


The most correct opinion is as follows:


❀ If a person misses the Sunnah of Fajr, it is permissible to make them up after the Fard prayer of Fajr.


❀ This act does not contradict the prohibition regarding performing voluntary prayers after Fajr.


❀ The reason is that the prohibition applies to those prayers which have no specific cause.


However:


❀ If a person wishes, he may delay making up these Sunnah prayers until the time of Duha.


❀ Provided that there is no fear of forgetting them or becoming occupied and thus missing them.


❀ In that case, it is preferable to perform the makeup of the Sunnah of Fajr at the time of Duha.


This is what I hold, and Allah knows best what is correct.
