Ruling on a Believer Killed While Living in Enemy Territory
❖ Ruling:
If a believer is killed while residing in the land of the enemy, then there is no diyah (blood money) to be paid. The obligation in this case is only to free one believing slave as expiation (kafarah).
✿ Qur’an says:
فَإِن كَانَ مِن قَوْمٍ عَدُوٍّ لَّكُمْ وَهُوَ مُؤْمِنٌ فَتَحْرِيرُ رَقَبَةٍ مُّؤْمِنَةٍ
(Surah al-Nisa: 92)
“And if the slain person belongs to a people hostile to you, but he is a believer, then (the expiation is) to free a believing slave.”
