Ruling on Habitual Oaths: No Kaffarah for Vain Swearing

❖ Question:​


What is the ruling regarding a person who habitually swears oaths in regular speech?

❖ Answer:​


If a person uses oaths as a habitual phrase in their speech, then such oaths hold no legal weight. These are considered vain (laghw) oaths, and no expiation (kaffārah) is required for them.


❀ Allah Almighty states:​


﴿لَا يُؤَاخِذُكُمُ اللَّهُ بِاللَّغْوِ فِي أَيْمَانِكُمْ﴾
(Surah al-Baqarah: 225)

“Allah will not call you to account for your unintentional (vain) oaths.”


❀ Sayyidah ʿĀ’ishah رضي الله عنها said regarding this verse:​


"This verse was revealed about the people's habit of saying in their speech: 'By Allah! By Allah!'”

(Ṣaḥīḥ al-Bukhārī: 6663)


Meaning, unintentional oaths uttered casually or as a habitual phrase during conversation are regarded as Yamīn Laghw (vain oaths).

✅ Conclusion:​


◈ Oaths uttered out of habit in ordinary speech carry no legal consequence.
◈ They are classified as vain oaths (لغو قسم).
No expiation (kaffārah) is necessary in such cases.
