Question:
Should a person who dies after being crushed under a wall be given Ghusl (ritual washing)?
Source: Fatawa Ameenpuri by Shaykh Ghulam Mustafa Zaheer Ameenpuri
A person who dies after being crushed under a wall is considered a ḥukmī shahīd (legal martyr). And a ḥukmī shahīd is to be given both Ghusl (ritual washing) and Kafan (shrouding).
Sayyiduna Abu Hurairah رضي الله عنه narrated that the Messenger of Allah ﷺ said:
المطعون شهيد، والمبطون شهيد، والغريق شهيد، والهدم شهيد، والمقتول في سبيل الله شهيد
“There are five types of martyrs:
① One who dies of plague,
② One who dies due to abdominal illness,
③ One who drowns,
④ One who dies by being crushed (e.g., under a wall),
⑤ And one who is killed in the path of Allah.”
(Ṣaḥīḥ al-Bukhārī: 2829; Ṣaḥīḥ Muslim: 1914)
The one who dies due to being crushed—such as under a collapsed wall—is granted the status of a ḥukmī shahīd. Such individuals are to be washed and shrouded, unlike a shahīd fī sabīlillāh (martyr in battle), who is not given Ghusl.
