Question:
What is the ruling on forcing someone to sell his property?
Source: Fatāwā Amunpuri by Shaykh Ghulam Mustafa Zaheer Amunpuri
Answer:
It is ḥarām to compel an owner to sell his property. While one may request or insist, it is not permissible to force, threaten, or coerce the seller into making a sale.
Scholarly Consensus:
❀ Ḥāfiẓ Ibn al-Mulaqqin رحمه الله (804 AH):
الإجماع قائم على أن الإكراه على البيع والهبة لا يجوز
“There is consensus that coercion in sales or gifts is not permissible.”
(al-Tawḍīḥ, 37/32)

- Persuasion is allowed, but coercion is prohibited.
- Coerced transactions are not valid in Sharīʿah.
- Scholars unanimously agree that forcing someone in sales or gifts is unlawful.
