Ruling on Entering Into Ihram for Hajj Before the Commencement of Hajj Months

Source: Fatawa Arkan-e-Islam

❖ Question

What is the ruling on wearing Ihram for Hajj before the beginning of the prescribed Hajj months?

❖ Answer

Alḥamdulillāh, waṣ-ṣalātu was-salāmu ‘alā Rasūlillāh, ʾAmma ba‘d!

There is a difference of opinion among scholars regarding the validity of entering into Ihram for Hajj before the beginning of the Hajj months.

❖ Opinion of Some Scholars

✔ According to some scholars, if a person wears Ihram for Hajj before the start of the Hajj months, the action is invalid.
✔ In their view, any Ihram worn before the appointed time would be counted as Ihram for ‘Umrah, not for Hajj.

❖ Evidence for This View

The Noble Prophet ﷺ stated:
«دَخَلَتْ فِی الْحَجِّ»
(Ṣaḥīḥ Muslim, Kitāb al-Ḥajj, Bāb: The Permissibility of Performing ‘Umrah During the Months of Hajj, Ḥadīth: 1241)
"It has entered into the [time of] Hajj."

✔ From this, scholars deduce that there is a specific period for Hajj to begin, and Ihram for Hajj outside this time frame does not count as valid Ihram for Hajj**.

✔ Additionally, the Prophet ﷺ referred to ‘Umrah as "Ḥajj al-Aṣghar" (the Lesser Hajj), as mentioned in the well-known Mursal narration of ʿAmr ibn Ḥazm رضي الله عنه:

(Sunan al-Dāraqutnī: 2/285)

✔ This narration has been accepted by the scholars as authentic in meaning and implication.
