Does Divorce Take Effect If Given in Jest?

Question:
Does divorce take effect if it is pronounced in jest?
Answer:
Yes, divorce given in jest does take effect.
Hadith Evidence
Abū Hurayrah (رضي الله عنه) reported that the Messenger of Allah ﷺ said:
ثلاث جدهن جد، وهزلهن جد؛ النكاح، والطلاق، والرجعة
“There are three things which, whether said in seriousness or in jest, are treated as serious: marriage, divorce, and taking back (a wife in rajʿah).”

- Imām al-Tirmidhī (رحمه الله) graded it ḥasan gharīb.
- Imām Ibn Jarūd (رحمه الله, d. 712 AH) graded it ṣaḥīḥ.
- Imām al-Ḥākim (رحمه الله) said: ṣaḥīḥ al-isnād (authentic in chain).
- Ḥāfiẓ Ibn Ḥajar (رحمه الله) declared it ḥasan.

Scholarly Consensus
ʿAllāmah Abū ʿAbdullāh al-Qurṭubī (رحمه الله, d. 671 AH) stated:
لا خلاف بين العلماء أن من طلق هازلا أن الطلاق يلزمه
“There is no difference among the scholars that if a man divorces in jest, the divorce is binding upon him.”


A divorce given in jest is valid and binding according to the consensus of the scholars.
