Question
What do the scholars of Islam say regarding this issue: In a village, there are three scholars — one Ahl-e-Ḥadīth and two Ḥanafī. When the Ahl-e-Ḥadīth scholar got married, at the time of nikāḥ he said that a nikāḥ conducted by a Ḥanafī scholar is not valid, so he recited his own nikāḥ. Both parties had witnesses present. Was this nikāḥ valid or not?
✔ Answer
Alḥamdulillāh, waṣ-ṣalātu was-salāmu ʿalā Rasūlillāh, Ammā Baʿd!
It should be understood that if the nikāḥ was performed in accordance with the conditions laid down in the Qur’an and Sunnah, then without any doubt, this nikāḥ is valid and correct — even though this particular scenario may not have been directly addressed.
The nikāḥ sermon (khuṭbah) is essentially a Sunnah supplication, and the Qur’an and ḥadīth have not restricted this supplication to any specific person.
Therefore, if an individual recites this supplication himself — even if he is present as part of the assembly — it is permissible, and the nikāḥ is valid.
Hadhā mā ʿindī, wallāhu aʿlam bis-ṣawāb.
