Prohibition of marriage without a guardian and intercourse with a pregnant captive woman

This excerpt is taken from Sheikh Hussain bin Mubarak Al-Mosuli's Arabic book Al-Awamer wal-Nawahi, which was translated into Urdu by Muhammad Sarwar Gohar Sahib under the title Ahkamat o Mamnoaat.

Prohibition of Marriage Without a Guardian​

① It is narrated from Sayyida Aisha (may Allah be pleased with her) that the Messenger of Allah (peace be upon him) said:
أيما امرأة نكحت بغير إذن وليها فنكاحها باطل ، فإن دخل بها فالمهر لها بما استحل من فرجها ، فإن اشتجروا فالسلطان ولي من لا ولي له
“A woman who marries without the permission of her guardian, her marriage is invalid. If she has established the marital relationship with him, then she is entitled to the dowry because it is due to this that her private parts have become lawful for that man. If they fall into disagreement and discord, then the one who has no guardian, his guardian is the king.”

② It is narrated from Sayyiduna Abu Musa (may Allah be pleased with him) that the Messenger of Allah (peace be upon him) said:
لا نكاح إلا بولي
“There is no marriage without a guardian (wali).”

Prohibition of Intercourse with a Pregnant Captive Slave Woman​

① Sayyiduna Ruwaifi' ibn Thabit Ansari رضي الله عنه narrates that I heard the Messenger of Allah صلی اللہ علیہ وسلم say on the occasion of the Battle of Hunain:
لا يحل لامرئ يؤمن بالله واليوم الآخر أن يسقي ماءه زرع غيره - يعني إتيان الحبالىٰ - ولا يحل لامرئ يؤمن بالله واليوم الآخر أن يقع علىٰ امرأة من السبي حتىٰ يستبرئها ، ولا يحل لامرئ يؤمن بالله واليوم الآخر أن يبيع مغنما حتىٰ يقسم
"A person who believes in Allah and the Last Day is not permitted to give his water (semen) to another's field, meaning to have intercourse with a pregnant woman, and a person who believes in Allah and the Last Day is not permitted to have intercourse with a slave woman who has been captured until her womb is cleared of menstruation, and it is not permissible for a person who believes in Allah and the Last Day to sell the spoils of war before they are distributed."
