Prohibition of killing women, children, and non-combatants and avoidance of impatience

This excerpt is taken from the Arabic book Al-Awamer wal-Nawahi by Sheikh Hussain bin Mubarak Al-Mawsili, whose Urdu translation has been done by Muhammad Sarwar Gohar Sahib under the title Ahkamat o Mamnoaat.


Prohibition of Killing Women and Children​


① Sayyiduna Ibn Umar رضي الله عنهما narrates that in a certain battle, a woman was found killed, so the Messenger of Allah صلی اللہ علیہ وسلم forbade killing women and children.

Prohibition of Killing Dhimmis​


① Sayyiduna Abdullah bin Umar رضي الله عنهما narrates that the Messenger of Allah صلی اللہ علیہ وسلم said:
من قتل معاهدا لم يرح رائحة الجنة ، وإن ريحها يوجد من مسيرة أربعين عاما
"Whoever kills a Dhimmi (a person under covenant) will not even smell the fragrance of Paradise, although its fragrance can be perceived from a distance of forty years."

Prohibition of Taking Wages for Distribution​


① It is narrated from Sayyiduna Abu Saeed Khudri (may Allah be pleased with him) that the Messenger of Allah (peace be upon him) said:
إياكم والقسامة
"Avoid Qasamah."
We asked: What is Qasamah? He (peace be upon him) said:
الشيء يكون بين الناس فينقص منه
"When something is jointly owned by people and someone takes some of it away."
And in another narration, the Prophet (peace be upon him) said:
الرجل يكون على الفئام من الناس فيأخذ من حظ هذا وحظ هذا
"A man will be appointed over several groups of people; sometimes he will take from their share and sometimes he will take from their share."

Prohibition of Impatience and Panic​


① It is narrated from Sayyiduna Amr ibn Taghlib رضي الله عنه that some wealth and captives were brought to the Messenger of Allah صلی اللہ علیہ وسلم. He صلی اللہ علیہ وسلم gave to some people and did not give to others. The news reached the Prophet صلی اللہ علیہ وسلم that those who were not given were displeased, so the Prophet صلی اللہ علیہ وسلم praised and glorified Allah, then said:
أما بعد، فوالله إني لأعطي الرجل وأدع الرجل والذي أدع أحب إلى من الذى أعطي ، ولكني أعطي أقواما أرى فى قلوبهم الجزع والهلع ، وأكل أقواما إلى ما جعل الله فى قلوبهم من الغنى والخير ، منهم عمرو بن تغلب
"After this! By Allah! I give to some and do not give to others, and the one whom I do not give is dearer to me than the one whom I give, but in those whom I give, I see restlessness and impatience in their hearts, and those whom I leave out, it is because of the contentment and goodness that has been created in their hearts. Amr ibn Taghlib is also among them."
He (Sayyiduna Amr ibn Taghlib رضي الله عنه) says: By Allah! I do not wish that I receive red camels in exchange for this statement of the Messenger of Allah صلی اللہ علیہ وسلم.
