Prohibition and Punishment of Child Labor and Prohibition of Intercession in Hudood

This excerpt is taken from Sheikh Hussain bin Mubarak Al-Mawsili's Arabic book Al-Awamer wal Nawaahi, whose Urdu translation has been done by Muhammad Sarwar Gohar Sahib under the title Ahkaamat o Mamnooat.


Prohibition of Boy Play​


① It is narrated from Sayyiduna Amr bin Abi Amr, may Allah be pleased with them, that the Messenger of Allah, peace be upon him, said:
ملعون من عمل عمل قوم لوط
Whoever commits the act of the people of Lut is accursed.

② It is narrated from Sayyiduna Ibn Abbas, may Allah be pleased with them, that the Messenger of Allah, peace be upon him, said:
من وجدتموه يعمل عمل قوم لوط فاقتلوا الفاعل والمفعول به
If you find a person committing the act of the people of Lut, then kill both the doer and the one to whom it is done.

③ It is narrated from Sayyiduna Ibn Abbas, may Allah be pleased with them, that the Messenger of Allah, peace be upon him, said:
لا ينظر الله عز وجل إلى رجل أتى رجلا أو امرأة فى دبرها
Allah, the Exalted, will not look with mercy at a man who has intercourse with the back of a man or a woman.

Punishment for One Who Commits Boy Play​


① It is narrated from Sayyiduna Ibn Abbas رضي الله عنهما that the Messenger of Allah صلی اللہ علیہ وسلم said:
من وجدتموه يعمل عمل قوم لوط فاقتلوا الفاعل والمفعول به
Whoever you find committing the act of the people of Lot (sodomy), kill both the one who does it and the one to whom it is done.

Prohibition of Intercession in Hudood​


① It is narrated from Sayyida Aisha (may Allah be pleased with her) that a woman from the Makhzumi tribe who had committed theft was highly respected among the Quraysh. They said, "Who will intercede with the Messenger of Allah (peace be upon him) on behalf of this woman?" But no one dared to speak to him. Then Sayyiduna Usama (may Allah be pleased with him) spoke to him, and the Messenger of Allah (peace be upon him) said:
أتشفع فى حد من حدود الله
"Do you intercede regarding any of the limits set by Allah?" Then the Prophet (peace be upon him) stood up and delivered a sermon, saying:
إنما هلك الذين من قبلكم أنهم كانوا إذا سرق فيهم الشريف تركوه ، وإذا سرق فيهم الضعيف أقاموا عليه الحد، وأيم الله لو أن فاطمة بنت محمد سرقت لقطعت يدها
"People before you were destroyed because if a noble person among them stole, they would let him go, but if a weak person among them stole, they would apply the punishment to him. By Allah! If Fatimah, the daughter of Muhammad (peace be upon him), were to steal, I would cut off her hand."

② Yahya bin Rashid narrates that one day we were waiting for Sayyiduna Ibn Umar (may Allah be pleased with them both), and when he came to us, I heard him say that he heard the Messenger of Allah (peace be upon him) say:
من حالت شفاعته دون حد من حدود الله فقد ضاد الله عز وجل، ومن خاصم على باطل وهو يعلم لم يزل فى سخط الله حتى ينزع، ومن قال فى مؤمن ما ليس فيه أسكنه الله ردغة الخبال حتى يخرج مما قال
"Whoever intercedes in the enforcement of any of Allah's limits has opposed Allah. And whoever knowingly litigates falsely remains in Allah's displeasure until he withdraws from it. And whoever slanders a believer, Allah will cast him into the mire of distress until he retracts his statement."
And in one narration, this was added:
ومن أعان على خصومة بظلم فقد باء بغضب من الله
"Whoever assists in an unjust case becomes deserving of Allah's wrath."
