Marriage of a Man Who Forces His Wife into Prostitution – Is It Still Valid?

❖ Question:​


If a man forces his wife into prostitution, does the nikāḥ (marriage contract) still remain valid?


✿ Answer:​


➤ The earnings from fornication are ḥarām (forbidden) and have been severely condemned in Islam.
➤ However, such sinful behavior does not invalidate the nikāḥ.
➤ Such a man is regarded as a diyyūth — a person who has no protective jealousy over his womenfolk.


✦ Ḥadīth Evidence:​


Sayyidunā ʿAbdullāh ibn ʿUmar رضي الله عنهما narrated:


ثَلَاثَةٌ لَا يَدْخُلُونَ الْجَنَّةَ، وَلَا يَنْظُرُ اللَّهُ إِلَيْهِمْ يَوْمَ الْقِيَامَةِ: الْعَاقُّ لِوَالِدَيْهِ، وَالْمَرْأَةُ الْمُتَرَجِّلَةُ الْمُتَشَبِّهَةُ بِالرِّجَالِ، وَالدَّيُّوثُ


Translation:

Three types of people will not enter Paradise, nor will Allah look at them on the Day of Resurrection:


The one who is disobedient to his parents,
A woman who imitates men,
And a diyyūth (a man who has no jealousy over his women).


📚 Musnad Aḥmad: 6180 – Ḥasan isnād


Sayyidunā Abū Masʿūd رضي الله عنه narrated:


"The Messenger of Allah ﷺ forbade the price of a dog, the earnings of a prostitute, and the payment given to a fortune-teller."

📚 Ṣaḥīḥ al-Bukhārī: 2237
📚 Ṣaḥīḥ Muslim: 1567


Sayyidunā Rāfiʿ ibn Khadīj رضي الله عنه narrated:


"The price of a dog is evil, the wage of a prostitute is evil, and the fee for cupping is evil."

📚 Ṣaḥīḥ Muslim: 1568


Sayyidunā Abū Hurayrah رضي الله عنه narrated:


"The Messenger of Allah ﷺ forbade the earnings from a dog, from prostitution, and from cupping."

📚 Musnad Aḥmad: 7976
📚 Sunan al-Nasā’ī: 4673 – Ṣaḥīḥ isnād


In another narration, he ﷺ said:


"The price of a dog, the payment to a soothsayer, and the earnings of a prostitute are not lawful."

📚 Sunan Abī Dāwūd: 3484
📚 Ṣaḥīḥ Abī ʿAwānah: 5273 – Ḥasan isnād


📝 Ḥāfiẓ Ibn Ḥajar رحمه الله declared the chain as ḥasan (good) in:
📚 Fatḥ al-Bārī: 4/426


✅ Summary:​


➤ Forcing one’s wife into prostitution is a major sin and renders the man a diyyūth, one of the most despised individuals in Islam.
The marriage remains valid, but the act is immoral, criminal, and spiritually destructive.
Zinā (fornication) earnings are completely forbidden, and participating in or profiting from such sin is a cause of Divine wrath.
➤ Such a person faces severe punishment in the Hereafter unless sincere repentance is made.
