It is Not Permissible to Keep a Woman and Her Paternal or Maternal Aunt in Marriage Simultaneously

❖ Prohibition of Simultaneous Marriage with a Woman and Her Aunt (Paternal or Maternal)​


➊ Narrated by Abu Hurairah رضي الله عنه:
The Messenger of Allah ﷺ said:
لا يجمع بين المرأة وعمتها ولا بين المرأة و خالتها
"A woman and her paternal aunt, or a woman and her maternal aunt, should not be combined in marriage by the same man."
[Bukhari: 5109, Book of Nikah: Chapter – A woman is not to be married along with her paternal aunt; Muslim: 1408; Ahmad: 2/465; Sa’id bin Mansur: 1/209; Musnad al-Shafi’i: 2/18; ‘Abd al-Razzaq: 10753]


➋ Another narration states:
نهي رسول الله صلى الله عليه وسلم أن تنكح المرأة على عمتها أو خالتها

"The Messenger of Allah ﷺ forbade that a woman be married along with her paternal aunt or maternal aunt."
[Bukhari: 5108 also; Abu Dawood: 2065; Tirmidhi: 1126; Darmi: 2/136; Ibn Abi Shaybah: 4/246; Ibn al-Jarood: 685; Nasa’i: 6/98]


❖ Scholarly Consensus and Rulings on the Matter​


Imam al-Shafi’i رحمه الله: Declared combining these relations in marriage as haram.
[Maʿrifat al-Sunan wa al-Āthār by al-Bayhaqi: 10/106]


Ibn ‘Abd al-Barr رحمه الله & Imam Nawawi رحمه الله: There is consensus (ijma‘) on the prohibition.
[Al-Tamhid: 18/277; Sharh Muslim: 5/207]


Ibn Hazm رحمه الله & Ibn al-Mundhir رحمه الله: They too reported consensus on the matter.
[As in Fath al-Bari: 10/202; Al-Ijma‘ by Ibn al-Mundhir: p. 95]


Imam Tirmidhi رحمه الله: Most scholars are agreed on this, and he did not find any differing opinion among them.
[Jami‘ Tirmidhi: After Hadith 1126]


Imam Shawkani رحمه الله & Amir San‘ani رحمه الله: Declared it haram to combine these relations in marriage.
[Nayl al-Awṭar: 4/228; Sabil al-Salam: 3/1329]


Imam al-Qurtubi رحمه الله & Siddiq Hasan Khan رحمه الله: Stated that there is ijma‘ on its prohibition.
[Al-Rawdah al-Nadiyyah: 2/50]


✅ Conclusion:​


It is unanimously forbidden in Islam to marry a woman and her paternal aunt (phuppi) or maternal aunt (khaala) at the same time. This ruling is supported by authentic narrations and scholarly consensus from classical to later generations.
