❖ Question
What do the esteemed scholars say regarding this case:
Alhdad passed away, leaving behind:
◄ One wife
◄ Mother
◄ Two brothers
According to the Shariah of Muhammad ﷺ, how should the inheritance be distributed among them?
❖ Answer
Al-ḥamdu lillāh, waṣ-ṣalātu was-salāmu ʿalā Rasūlillāh, ammā baʿd!
The division of inheritance must follow this sequence:
➊ Funeral and burial expenses are deducted.
➋ Any debts of the deceased are paid.
➌ If there is a valid bequest, it is executed from up to one-third of the estate.
After these matters, the remaining estate is considered as 1 Rupee and distributed as follows:
Classical Distribution (Based on 1 Rupee Estate)
Heirs | Paisa | Anna |
---|---|---|
Wife | 08 | 04 |
Mother | 08 | 02 |
Two brothers (jointly) | 04 | 09 |
Decimal System Distribution (Total = 100)
◈ Wife → 25% (¼)
◈ Mother → 16.66% (⅙)
◈ Two brothers (ʿaṣabah) → 58.34% → each 29.17%
