❖ Question
What do the esteemed scholars say regarding this case:
Hajani Jiandal alias Naseem passed away about a month ago. She had no children.
Her estate included:
◄ Approximately 36–39 acres of agricultural land
◄ One house in the city
She left behind the following heirs:
◄ Two real sisters
◄ One husband
How should her estate be distributed according to the Shariah of Muhammad ﷺ?
❖ Answer
Al-ḥamdu lillāh, waṣ-ṣalātu was-salāmu ʿalā Rasūlillāh, ammā baʿd!
It must be remembered that before distribution of the estate:
➊ Funeral and burial expenses are deducted.
➋ Any debts are repaid.
➌ Any valid will is executed, but only from up to one-third (⅓) of the wealth.
➍ Thereafter, the remaining property is distributed among the heirs.
Distribution of Estate
If the entire estate of the deceased Jiandal alias Naseem is assumed as 1 Rupee, the division is as follows:
Classical System (Anna):
◄ Husband = 8 annas
◄ Sister = 4 annas
◄ Sister = 4 annas
Decimal / Percentage System (Total = 100):
◄ Husband = ½ → 50%
◄ Two sisters = ½ → 25% each
