If a husband divorces his wife before consummation (before Rukhsatī), is she required to observe ʿIddah?
No, if a divorce takes place before consummation or seclusion, then there is no ʿIddah (waiting period) upon the woman.
❀ Allah Almighty says:
﴿يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا نَكَحْتُمُ الْمُؤْمِنَاتِ ثُمَّ طَلَّقْتُمُوهُنَّ مِن قَبْلِ أَن تَمَسُّوهُنَّ فَمَا لَكُمْ عَلَيْهِنَّ مِنْ عِدَّةٍ تَعْتَدُّونَهَا ۖ فَمَتِّعُوهُنَّ وَسَرِّحُوهُنَّ سَرَاحًا جَمِيلًا﴾
[Surah al-Aḥzāb: 49]
“O you who believe! When you marry believing women and then divorce them before you have touched them (i.e., consummated the marriage), then you have no waiting period (ʿIddah) to count for them. So give them a suitable gift and release them in a gracious manner.”
❀ Ḥāfiẓ Ibn al-Jawzī رحمه الله (d. 597 AH) stated:
“There is consensus among the scholars that if divorce takes place before consummation or seclusion, then there is no ʿIddah upon the woman.”

❀ Ḥāfiẓ Ibn Kathīr رحمه الله (d. 774 AH) said:
“This is a matter of consensus among the scholars that a woman divorced before consummation does not have to observe ʿIddah, and she may remarry immediately. The only exception to this is a woman whose husband dies. In that case, even if the marriage was not consummated, she must observe a waiting period of four months and ten days, and this too is by consensus.”

◈ Consensus of Scholars (Ijmāʿ):
❀ Ḥāfiẓ Ibn al-Jawzī رحمه الله (d. 597 AH) stated:

Conclusion:
- If a woman is divorced before consummation (or before seclusion), she is not obligated to observe ʿIddah.
- She may marry immediately.
- Exception: If the husband dies, the widow must observe ʿIddah of 4 months and 10 days, even if consummation did not occur, by scholarly consensus.
