✿ The Continuity of Ijtihād in Islamic Law​


There is a widespread misconception that ijtihād (independent legal reasoning) ceased after the early generations. However, the lives of Imām Abū Ḥanīfah, other leading jurists, and their successors refute this claim.


One of the most remarkable examples of post-classical ijtihād is the life and contributions of Imām al-Sarakhsī رحمه الله.

✿ Introduction to Imām Sarakhsī​


Name and Era:

  • Shams al-Aʾimmah Abū Bakr Muḥammad ibn Abī Sahl al-Sarakhsī
  • Born in the early 5th century AH (approx. 400 AH / 1000 CE)
  • Originated from Sarakhs, near the modern-day border of Turkmenistan and Iran


✿ Teachers and Students​


  • Studied under Shams al-Aʾimmah ʿAbd al-ʿAzīz al-Ḥalwānī (d. 448 AH / 1056 CE)
  • Among his notable academic descendants was the grandfather of Imām al-Marghīnānī, author of al-Hidāyah
  • His intellectual chain extended to Imām al-Kāsānī, author of Badāʾiʿ al-Ṣanāʾiʿ


✿ Academic Career and Teaching​


  • Taught Islamic law at the Ḥalawiyyah Madrasa in Ḥalab (Aleppo)
  • The same institution later became home to Imām al-Kāsānī


✿ The Trial of Imprisonment​


➤ Reason for Imprisonment:​


While teaching in Farghānah, Imām Sarakhsī gave a legal ruling (fatwā) that displeased the local ruler.
When pressured to retract it, he refused, leading to his imprisonment in a fortress well.


  • Imprisoned from 466 AH (1074 CE) to 480 AH (1088 CE)
  • 14 years of confinement


✿ Steadfastness and Scholarly Resolve​


Despite severe conditions, Imām Sarakhsī:


  • Did not compromise on truth
  • Continued his scholarly contributions from within prison
  • Displayed a level of patience and devotion rarely seen in history


✿ Scholarly Contributions During Imprisonment​


al-Mabsūṭ (المبسوط):​


  • A 30-volume commentary on the Ḥanafī text al-Kāfī
  • Dictated from prison to students outside the fortress
  • A monumental legal encyclopedia, rich in juristic reasoning and Usūl al-Fiqh

Uṣūl al-Sarakhsī (أصول السرخسي):​


  • A two-volume work on the principles of jurisprudence
  • Originally titled Tamḥīd al-Fuṣūl fī al-Uṣūl
  • Still considered a core reference in Ḥanafī legal theory

Sharḥ al-Siyar al-Kabīr:​


  • A five-volume commentary on Imām Muḥammad’s al-Siyar al-Kabīr,
    the most detailed classical work on Islamic international law and jihād


✿ A Supplication That Reflects His Soul​


Imām Sarakhsī concluded one of his works with this powerful and poetic plea:


"The commentary on al-Siyar al-Ṣaghīr is complete, a work filled with profound meaning, dictated by one who speaks with enlightened truth, but is restricted like a captive—awaiting relief from the All-Powerful, All-Hearing, All-Seeing Lord."
