Hunting Dog Catching Prey on Its Own: Islamic Ruling and Scholarly Consensus

The Islamic Ruling on Game Caught by a Hunting Dog Without Being Released​

❖ Question​


If a hunting dog is not released by its owner but catches and kills prey on its own, what is the ruling on such game?


❖ Answer​


Hunting with a trained dog is permissible. If the dog has been trained for hunting and is released upon the prey with Bismillah, then if it wounds and brings the prey alive, it should be slaughtered, and it will be halal. Even if the trained dog wounds the prey and it dies before slaughter, the game is still halal — provided no other dog participated in the hunt.


However:


  • If the hunter did not release the dog, and the dog went on its own and caught prey:
    • If the prey is still alive, it can be slaughtered with takbir, and it will be halal.
    • If the prey has already died, it is not halal, rather it is haram. On this matter, there is consensus (ijma‘).

❀ Sayyiduna ʿAdi ibn Hatim (RA) narrated:


قلت: يا رسول الله، إني أرسل الكلاب المعلمة...


“I said: O Messenger of Allah! I release my trained hunting dogs, and they catch game for me, and I mention the Name of Allah upon it. The Messenger of Allah ﷺ said: ‘When you release your trained dog and mention the Name of Allah upon it, then eat (what it catches).’ I said: ‘Even if they kill it?’ He said: ‘Even if they kill it, as long as no other dog, not from them, shares in the catch.’”

❀ Hafiz al-Baghawi (رحمه الله, 516H) said:


دليل على أن الإرسال من جهة الصائد شرط، حتى لو خرج الكلب بنفسه، فأخذ صيدا وقتله، لا يكون حلالا، أجمعت الأمة عليه.


“This hadith proves that releasing (the dog) by the hunter is a condition. If the dog goes on its own, catches prey, and kills it, then it is not halal. The Ummah has reached consensus on this.”
