Guarantee (Compensation) and Insurance in Case of Accidental Loss

Authored by: Fatwas of the Saudi Fatwa Committee

When dealing with unforeseen incidents in homes or shops, such as accidental damage during efforts to prevent or mitigate a disaster, the following rulings apply:
  1. No Compensation or Guarantee Required:
    • If property or items are accidentally damaged during an effort to handle or stop an unforeseen incident, there is no obligation to provide compensation or a guarantee.
  2. Reason:
    • The act of preventing or mitigating the incident is considered permissible in Islamic law.
    • Any loss or damage that occurs as a result of such permissible actions does not warrant liability or compensation.
This ruling ensures fairness in situations where individuals are engaged in lawful acts for damage prevention or control.
