Expiation for Intercourse During Menstruation

Question:
What is the expiation (kafarah) for intercourse during menstruation?
Answer:
If a man has intercourse with his wife during menstruation, the expiation is to give in charity one dinar (4.374 grams of gold) or half a dinar (2.187 grams of gold).
❀ Sayyiduna Abdullah ibn Abbas رضي الله عنهما narrated:
Regarding one who has intercourse with his wife in her menstrual period, the Messenger of Allah ﷺ said:
يتصدق بدينار، أو بنصف دينار.
“Let him give in charity one dinar or half a dinar.”
(Musnad Ahmad: 1/229-230, Sunan Abi Dawud: 264, Sunan al-Nasa’i: 290, Sunan al-Tirmidhi: 136, Sunan Ibn Majah: 640 — authentic chain)
- This Hadith has been authenticated by Imam Ahmad ibn Hanbal, Imam Abu Dawud, Imam Ibn Jarud, Imam al-Hakim, Hafiz Ibn Qattan, Hafiz al-Dhahabi, Hafiz Ibn Daqiq al-‘Id, Hafiz Ibn al-Qayyim, Allamah Ibn al-Turkmani al-Hanafi, and Hafiz Ibn Hajar.
- It is established both as marfu‘ (Prophet’s statement) and mawquf (fatwa of Ibn Abbas). The mawquf narration strengthens the marfu‘ Hadith.
The Salaf also held this view:
① Sayyiduna Abdullah ibn Abbas رضي الله عنهما issued this fatwa.
② Imam Ahmad ibn Hanbal رحمه الله and Imam Ishaq ibn Rahwayh رحمه الله said the same. (Sunan al-Tirmidhi, under Hadith: 137)
③ ‘Ata ibn Abi Rabah رحمه الله said: “He should give one dinar in charity.” (Sunan al-Darimi: 1154, Sahih chain)
Another narration from him mentions half a dinar. (Sunan al-Darimi: 1157, Hasan chain)
Some scholars said there is no expiation other than repentance and seeking forgiveness, but this opinion is weak, as it contradicts the authentic Hadith and the understanding of the Salaf.
