Eloquence in disputes, making unjust decisions, and prohibition of bribery

This excerpt is taken from Sheikh Hussain bin Mubarak Al-Mosuli's Arabic book Al-Awamer wal-Nawahi, which was translated into Urdu by Muhammad Sarwar Gohar under the title Ahkamat o Mamnoaat.


Prohibition of Eloquence in Disputes​


① It is narrated from Sayyida Umm Salamah (may Allah be pleased with her) that when the Messenger of Allah (peace be upon him) heard a dispute at the door of his chamber, he came to them and said:
إنما أنا بشر، وإنه يأتيني الخصم، فلعل بعضهم يكون أبلغ من بعض، فأحسب أنه صدق ، فأقضي له بذلك، فمن قضيت له بحق مسلم فإنما هي قطعة من النار فليحملها أو يذرها
"I am also a human being; disputes come to me, and it is possible that some speak more eloquently than others, and I may believe them and judge in their favor. If I give a person the right of a Muslim (which is not his), then he is a piece of fire; he may take it or leave it."

Prohibition of Unjust Judgment​


① Sayyiduna Ibn Abi Awfa رضي الله عنه narrates that the Messenger of Allah صلی اللہ علیہ وسلم said:
الله مع القاضي ما لم يجر ، فإذا جار تخلى عنه ولزمه الشيطان
"Allah is with the judge who does not oppress, so when he oppresses, He distances Himself from him and Satan clings to him."

② Sayyiduna Buraidah رضي الله عنه narrates that the Messenger of Allah صلی اللہ علیہ وسلم said:
القضاة ثلاثة واحد فى الجنة واثنان فى النار، فأما الذى فى الجنة فرجل عرف الحق وقضى به ورجل عرف الحق فجار فى الحكم فهو فى النار، ورجل قضى للناس على جهل فهو فى النار
"There are three types of judges: one is destined for Paradise and two for Hell. The one destined for Paradise is the person who recognizes the truth and judges accordingly; the one who recognizes the truth but judges unjustly is destined for Hell; and the one who judges between people out of ignorance is also destined for Hell."

Prohibition of Bribery​


① It is narrated from Sayyiduna Abu Hurairah (may Allah be pleased with him) that the Messenger of Allah (peace be upon him) said:
لعن الراشي والمرتشي فى الحكم
"Cursed is the one who gives a bribe and the one who takes a bribe in judgment."
Reference: Tirmidhi, Al-Ahkam 1336. The hadith is Hasan Sahih. Musnad Ahmad, and the Musnad of the most frequent narrators 2/513.

② It is narrated from Ibn Umar (may Allah be pleased with both of them) that the Messenger of Allah (peace be upon him) said:
لعن الراشي والمرتشي فى الحكم
"Cursed is the one who gives a bribe and the one who takes a bribe in judgment."
