Ruling on Divorce After ‘Iddah and the Issue of a Second Divorce Without Revocation​

❀ The Question​


Does a second divorce take effect without ruju‘ (revocation)? Also, after how many days can a second divorce be validly given? (Please explain with evidence).


❀ The Answer​


If the husband gives a second divorce after the first one with some interval, it does take effect, regardless of whether he had made ruju‘ after the first divorce or not.


Allah Almighty says:
﴿ٱلطَّلَٰقُ مَرَّتَانِ﴾ (البقرة: 229)
“Divorce is twice…”


This verse includes both scenarios:
① When there is ruju‘ between the first and second divorce.
② When there is *no ruju‘ between the first and second divorce.


There is no evidence in Qur’an or Sunnah that restricts this verse only to those cases where ruju‘ occurs between the divorces.


Hence, if a man divorces his wife once and then, after some interval, gives her a second divorce without revocation, the second divorce is still counted.


❀ Interval Between Divorces​


The Qur’an and Sunnah do not specify any particular number of days, nights, hours, or minutes between the first and second divorce.


The only condition proven in Shari‘ah is that:


  • If someone gives two, three, or more divorces at the same time, they all count as only one divorce.

❀ Divorce After ‘Iddah​


If a man gives his wife one divorce and her ‘iddah ends, then she is no longer his wife.


If, after the ‘iddah, he pronounces a second or third divorce, these have no effect—because divorce is only valid when the woman is still in the husband’s marital bond.


Allah Almighty says:
﴿فَبَلَغۡنَ أَجَلَهُنَّ فَلَا تَعۡضُلُوهُنَّ أَن يَنكِحۡنَ أَزۡوَٰجَهُنَّ إِذَا تَرَٰضَوۡاْ بَيۡنَهُم بِٱلۡمَعۡرُوفِۗ﴾ (البقرة: 232)
“When they have completed their term (‘iddah), do not prevent them from remarrying their (former) husbands, if they agree on reasonable terms.”


This verse proves that after the ‘iddah, the woman exits the marriage bond. Therefore, any divorce given after the ‘iddah is invalid, since divorce is only applicable to a wife under an existing marriage.


If both parties wish, they may contract a new nikah with mutual consent after the ‘iddah. But divorces pronounced after the ‘iddah hold no Shar‘i validity.


❀ Conclusion​


① A second divorce can be given without revocation of the first.
② Shari‘ah does not fix a specific number of days between divorces.
③ If the wife’s ‘iddah ends, she is no longer under the nikah, so any divorce afterward is invalid.
④ After ‘iddah, only a new nikah can restore the marital relationship.
