ʿIddah Ruling for Widow After Husband’s Death Before Consummation

❖ ʿIddah of a Widow Whose Husband Died Before Consummation ❖
This writing is excerpted from the book “500 Questions and Answers for Women” based on the Fatwas of the Scholars of the Haramain, translated by Hafiz Abdullah Saleem.


❖ Question:​


A man married a woman but passed away before consummating the marriage. Is ʿiddah (waiting period) obligatory upon his widow?


❖ Answer:​


Yes, ʿiddah is obligatory for a woman whose husband dies after the marriage contract (nikāḥ) but before consummation.


This is because a woman becomes a wife solely by the marriage contract, and hence:


❖ Evidences:​


Allah ﷻ says:


﴿وَالَّذِينَ يُتَوَفَّوْنَ مِنكُمْ وَيَذَرُونَ أَزْوَاجًا...﴾ [Al-Baqarah: 234]
“And those among you who die and leave behind wives—they shall wait concerning themselves for four months and ten days.”



② The Prophet ﷺ said:


“No woman should mourn for any deceased for more than three days, except for her husband—for him, she should mourn for four months and ten days.”
(Ṣaḥīḥ al-Bukhārī and Ṣaḥīḥ Muslim)


③ The Prophet ﷺ also issued a ruling regarding Barrah bint Wāshiq, whose husband died after nikāḥ but before consummation:


✔ She was commanded to complete the ʿiddah,
✔ And was declared entitled to inheritance.


❖ Conclusion:​


Therefore, even if the marriage was not consummated, the woman must:


✔ Observe an ʿiddah of four months and ten days,
✔ And is also entitled to inheritance from her deceased husband.
