ʿIddah of a Minor Girl Divorced After Puberty Without Consummation

❖ Question:
If a boy and girl were married while still minors, and after the girl reached puberty the boy divorced her before consummation or seclusion (khalwah), is she required to observe ʿiddah?
✿ Answer:
If divorce takes place before consummation (dūkhūl), then there is no ʿiddah. This is a matter of consensus (ijmāʿ). The woman may immediately marry again.
◈ Qur’ānic Evidence
﴿يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا نَكَحْتُمُ الْمُؤْمِنَاتِ ثُمَّ طَلَّقْتُمُوهُنَّ مِنْ قَبْلِ أَنْ تَمَسُّوهُنَّ فَمَا لَكُمْ عَلَيْهِنَّ مِنْ عِدَّةٍ تَعْتَدُّونَهَا فَمَتِّعُوهُنَّ وَسَرِّحُوهُنَّ سَرَاحًا جَمِيلًا﴾
(Sūrat al-Aḥzāb: 49)
“O you who believe! When you marry believing women and then divorce them before touching them (consummation), then there is no ʿiddah upon them for you to count. So provide for them and release them in a graceful manner.”

- A girl divorced before consummation, even if the marriage occurred in minority and divorce after puberty, has no ʿiddah.
- She may remarry immediately.
