ʿIddah of a Non-Consummated Wife After Husband’s Death

Question:​


If a woman’s husband dies before consummation (ghayr madkhūlah), is she required to observe ʿiddah?

Answer:​


Yes, if the husband of a non-consummated wife (ghayr madkhūlah) passes away, she must observe ʿiddah just like a consummated wife (madkhūlah). Her waiting period is four months and ten days, because the Qur’an does not exclude the non-consummated wife from this ruling.


Scholarly Consensus:​


Imām Ibn al-Mundhir رحمه الله (319 AH):


أجمع أهل العلم على أن عدة الحرة المسلمة من وفاة زوجها أربعة أشهر وعشرا مدخولا بها أو غير مدخول بها، صغيرة كانت أم كبيرة، تقيم المعتدة فى المنزل الذى كانت تسكنه أيام حياة زوجها إلا أن تخرج منه فيكون لها عذر فى الخروج
“The scholars are unanimous that the ʿiddah of a free Muslim woman, upon the death of her husband, is four months and ten days—whether consummated or not, young or old. The woman observing ʿiddah must remain in the house where she lived during her husband’s life, unless she has a valid excuse to leave.”
(al-Iqnāʿ, 1/324)


Ḥāfiẓ Ibn Kathīr رحمه الله (774 AH):


هذا أمر مجمع عليه بين العلماء أن المرأة إذا طلقت قبل الدخول بها لا عدة عليها فتذهب فتتزوج فى فورها من شاءت، ولا يستثنى من هذا إلا المتوفى عنها زوجها، فإنها تعتد منه أربعة أشهر وعشرا، وإن لم يكن دخل بها بالإجماع أيضا
“It is unanimously agreed among scholars that if a woman is divorced before consummation, she has no ʿiddah and may remarry immediately. The only exception is if her husband passes away. In that case, even if consummation has not occurred, she must observe an ʿiddah of four months and ten days—by consensus.”

✅ Conclusion:
A non-consummated wife (ghayr madkhūlah) whose husband passes away must observe an ʿiddah of four months and ten days, as established by Qur’an, Sunnah, and scholarly consensus.
