Hadith 612

أَنْبَأَنَا مَالِكٌ ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنِ ابْنِ كَثِيرِ بْنِ أَفْلَحَ ، عَنْ أَبِي مُحَمَّدٍ ، مَوْلَى أَبِي قَتَادَةَ , عَنْ أَبِي قَتَادَةَ الأَنْصَارِيِّ ، أَنَّهُ قَالَ : خَرَجْنَا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَامَ حُنَيْنٍ فَلَمَّا الْتَقَيْنَا كَانَتْ لِلْمُسْلِمِينَ جَوْلَةٌ ، قَالَ : فَرَأَيْتُ رَجُلا مِنَ الْمُشْرِكِينَ قَدْ عَلا رَجُلا مِنَ الْمُسْلِمِينَ ، قَالَ : فَاسْتَدَرْتُ لَهُ حَتَّى أَتَيْتُهُ مِنْ وَرَائِهِ حَتَّى ضَرَبْتُهُ عَلَى حَبْلِ عَاتِقِهِ ضَرْبَةً ، فَأَقْبَلَ عَلَيَّ فَضَمَّنِي ضَمَّةً حَتَّى وَجَدْتُ مِنْهَا رِيحَ الْمَوْتِ ثُمَّ أَدْرَكَهُ الْمَوْتُ ، فَأَرْسَلَنِي فَلحِقْتُ عُمَرَ بْنَ الْخَطَّابِ ، فَقُلْتُ : مَا بَالُ النَّاسِ ، فَقَالَ أَمْرُ اللَّهِ عَزَّ وَجَلَّ ، ثُمَّ إِنَّ النَّاسَ رَجَعُوا ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ قَتَلَ قَتِيلا لَهُ عَلَيْهِ بَيِّنَةٌ فَلَهُ سَلَبُهُ " ، فَقُمْتُ فَقُلْتُ : مَنْ يَشْهَدُ لِي ؟ ثُمَّ جَلَسْتُ ، ثُمَّ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ قَتَلَ قَتِيلا لَهُ عَلَيْهِ بَيِّنَةٌ فَلَهُ سَلَبُهُ " ، فَقُمْتُ وَقُلْتُ : مَنْ يَشْهَدُ لِي ؟ ثُمَّ جَلَسْتُ ، ثُمَّ قَالَ فِي الثَّالِثَةِ فَقُمْتُ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَا لَكَ يَا أَبَا قَتَادَةَ ؟ " فَاقْتَصَصْتُ عَلَيْهِ الْقِصَّةَ ، فَقَالَ رَجُلٌ مِنَ الْقَوْمِ : صَدَقَ يَا رَسُولَ اللَّهِ وَسَلَبُ ذَلِكَ الْقَتِيلِ عِنْدِي فَأَرْضِهِ مِنْهُ ، قَالَ أَبُو بَكْرٍ الصِّدِّيقُ رَضِيَ اللَّهُ عَنْهُ : لاهَا اللَّهِ إِذًا لا يَعْمِدُ إِلَى أَسَدٍ مِنْ أُسْدِ اللَّهِ يُقَاتِلُ عَنِ اللَّهِ وَعَنْ رَسُولِهِ فَيُعْطِيَكَ سَلَبَهُ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " صَدَقَ فَأَعْطِهِ إِيَّاهُ " ، قَالَ أَبُو قَتَادَةَ : فَأَعْطَانِيهِ فَبِعْتُ الدِّرْعَ فَابْتَعْتُ بِهِ مَخْرَفًا فِي بَنِي سَلَمَةَ فَإِنَّهُ لأَوَّلُ مَالٍ تَأَثَّلْتُهُ فِي الإِسْلامِ . قَالَ مَالِكٌ : الْمَخْرَفُ : النَّخْلُ . قَالَ أَبُو جَعْفَرٍ : دَفْعُ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ السَّلَبَ إِلَى أَبِي قَتَادَةَ بِإِقْرَارِ مَنْ هُوَ فِي يَدِهِ دَلِيلٌ عَلَى أَنَّ قَوْلَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ قَتَلَ قَتِيلا لَهُ عَلَيْهِ بَيِّنَةٌ فَلَهُ سَلَبُهُ " إِنَّمَا أَرَادَ : مَنْ قَتَلَ قَتِيلا وَلَهُ سَلَبٌ لَيْسَتْ عَلَيْهِ يَدُ الَّذِي يَدَّعِي أَنَّهُ قَاتِلُهُ . وَفِي ذَلِكَ مَا يَدُلُّ عَلَى أَنَّ الإِمَامَ إِذَا قَالَ : مَنْ قَتَلَ قَتِيلا فَلَهُ سَلَبُهُ ، فَأُصِيبَ سَلَبُهُ بِيَدِ رَجُلٍ فَقَالَ : هُوَ سَلَبُ قَتِيلٍ قَتَلْتُهُ وَلَمْ يُعْلَمْ ذَلِكَ إِلا بِقَوْلِهِ ، إِنَّ الْقَوْلَ فِي ذَلِكَ قَوْلُهُ . وَفِي قَوْلِ أَبِي قَتَادَةَ بِمَحْضَرِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَتَرْكِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ النَّكِيرَ عَلَيْهِ : مَنْ يَشْهَدُ لِي ، دَلِيلٌ عَلَى أَنَّ الشَّاهِدَ يَكُونُ شَاهِدًا بِمَا عَلِمَ وَإِنْ لَمْ يَسْتَدْعِهِ ذَلِكَ الْمَشْهُودُ لَهُ .
It is narrated from Sayyiduna Abu Qatadah Ansari (may Allah be pleased with him): We set out with the Messenger of Allah (peace and blessings of Allah be upon him) for the Battle of Hunayn. When we faced the enemy, there was chaos among the Muslims. I saw a polytheist who had climbed over a Muslim to kill him. I immediately turned around and reached him from behind, then struck his neck with my sword. He turned towards me and pressed me so hard that my soul was about to leave, then death overtook him and he let go of me. I met Sayyiduna Umar bin Khattab (may Allah be pleased with him) and said, "What happened to the people?" Sayyiduna Umar (may Allah be pleased with him) said, "The command of Allah." Then the people regained themselves, and the Messenger of Allah (peace and blessings of Allah be upon him) said: "Whoever has killed a disbeliever and brings proof of it, his belongings will be given to him." I stood up and said, "Who will testify for me?" (When no one did,) I sat down. Then the Messenger of Allah (peace and blessings of Allah be upon him) said: "Whoever has killed a disbeliever, let him bring proof and he will take his belongings." I stood up again and said, "Who will testify for me?" (No one spoke,) so I sat down. Then the Messenger of Allah (peace and blessings of Allah be upon him) announced a third time. I stood up, so the Messenger of Allah (peace and blessings of Allah be upon him) himself asked: "What is the matter with you, O Abu Qatadah?" I narrated the story. A man from the people said, "O Messenger of Allah! Qatadah (may Allah be pleased with him) is telling the truth. The belongings of his slain are with me. Please make him pleased with me (so that the belongings remain with me)." Then Sayyiduna Abu Bakr Siddiq (may Allah be pleased with him) spoke up: "No, by Allah! Then no lion of Allah will fight for Allah and His Messenger (peace and blessings of Allah be upon him) if his belongings are given to you." The Messenger of Allah (peace and blessings of Allah be upon him) said: "Abu Bakr (may Allah be pleased with him) has spoken the truth, give it to him." Then he (peace and blessings of Allah be upon him) took the belongings and gave them to Abu Qatadah (may Allah be pleased with him). Sayyiduna Abu Qatadah (may Allah be pleased with him) says: I sold the armor and bought a garden of Banu Salamah, and this was the first wealth I acquired after Islam. Malik (may Allah have mercy on him) says: "Mukhraf" refers to a date-palm tree.
