بَابُ مَا جَاءَ فِي طَلَاقِ السَّكْرَانِ وَمَنْ لَمْ يَرَهُ وَمَنْ أَجَازَهُChapter: What is reported regarding the divorce of the intoxicated, the absent, and those who permit it
Hadith 2299

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ وَغَيْرِ وَاحِدٍ مِنْ أَصْحَابِنَا عَنِ الشَّعْبِيِّ، قَالَا: «طَلَاقُ الْمَجْنُونِ فِي إِفَاقَتِهِ جَائِزٌ، وَإِذَا طَلَّقَ فِي غَيْرِ إِفَاقَتِهِ لَمْ يَجُزْ طَلَاقُهُ»
Ibrahim Nakha'i and Amir Sha'bi, may Allah have mercy on them, said: The divorce of a madman is valid when he is sane, but not valid when he is insane.
