بَابُ الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ فَيَدْخُلُ عَلَيْهَا وَمَعَهَا نِسَاءٌ فَوَقَعَ عَلَى امْرَأَةٍ مِنْهُنَّChapter: A man marries a woman, enters upon her, and there are other women with her, and he has intercourse with one of them

حَدَّثَنَا سَعِيدٌ، نا أَبُو مُعَاوِيَةَ، عَنْ عَاصِمٍ الْأَحْوَلِ، عَنْ السُّمَيْطِ السَّدُوسِيِّ قَالَ: " خَطَبْتُ امْرَأَةً، فَقَالُوا لِي: لَا نُزَوِّجُكَ حَتَّى تُطَلِّقَ امْرَأَتَكَ ثَلَاثًا. فَقُلْتُ: إِنِّي قَدْ طَلَّقْتُ ثَلَاثًا، فَزَوَّجُونِي، ثُمَّ نَظَرُوا فَإِذَا امْرَأَتِي عِنْدِي، فَقَالُوا: أَلَيْسَ قَدْ طَلَّقْتَ ثَلَاثًا؟ فَقُلْتُ: بَلَى، كَانَتْ عِنْدِي فُلَانَةُ بِنْتُ فُلَانٍ فَطَلَّقْتُهَا، وَفُلَانَةُ بِنْتُ فُلَانٍ فَطَلَّقْتُهَا، وَأَمَّا هَذِهِ فَلَمْ أُطَلِّقْهَا. فَأَتَيْتُ شَقِيقَ بْنَ مَجْزَأَةَ بْنِ ثَوْرٍ وَهُوَ يُرِيدُ أَنْ يَخْرُجَ إِلَى عُثْمَانَ بْنِ عَفَّانَ وَافِدًا، فَقُلْتُ لَهُ: سَلْ أَمِيرَ الْمُؤْمِنِينَ عَنْ هَذِهِ. فَخَرَجَ إِلَيْهِ فَسَأَلَهُ، فَقَالَ عُثْمَانُ: نِيَّتُهُ "
Samit Sudusi says: "I proposed marriage to a woman. She said: First, give your wife three divorces. I said: I have given three divorces. After the marriage, it was revealed that my wife was still present. When asked, I said: I had divorced other women, not her. Then it was asked to Sayyiduna Uthman bin Affan (may Allah be pleased with him), and he said: The intention will be taken into account."
