بَابُ الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ فَيَمُوتُ وَلَمْ يَفْرِضْ لَهَا صَدَاقًاChapter: A man marries a woman and dies without specifying a dowry for her
Hadith 2111

حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، قَالَ: حَدَّثَنِي عَطَاءٌ الْخُرَاسَانِيُّ، قَالَ: كَتَبَ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ إِلَى النَّاسِ فِي الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ، ثُمَّ يُطَلِّقُهَا قَبْلَ أَنْ يَدْخُلَ بِهَا، وَقَبْلَ أَنْ يَفْرِضَ لَهَا «أَنَّ لَهَا نِصْفَ الصَّدَاقِ، وَلَا عِدَّةَ عَلَيْهَا، وَلَا مِيرَاثَ لَهَا»
Hazrat Umar bin Abdul Aziz (may Allah have mercy on him) wrote: "If a man marries, and then divorces before consummation and before fixing the dowry, the woman will receive half the dowry, there will be no waiting period ('iddah), and she will not receive inheritance."
