بَابٌ: هَلْ يُوصِي الرَّجُلُ مِنْ مَالِهِ بِأَكْثَرَ مِنَ الثُّلُثِChapter: Can a man bequeath more than a third of his wealth?
Hadith 1542

سَعِيدٌ قَالَ: نا ابْنُ الْمُبَارَكِ، عَنْ يَعْقُوبَ بْنِ الْقَعْقَاعِ، عَنْ عَطَاءٍ، وَعَنْ مَطَرٍ، عَنِ الْحَسَنِ، فِي رَجُلٍ أَوْصَى لِبَنِي فُلَانٍ قَالَ: " الذَّكَرُ وَالْأُنْثَى سَوَاءٌ إِلَّا أَنْ يَكُونَ قَالَ {لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ} [النساء: 11]
Ata and Hasan al-Basri (may Allah have mercy on them) said: "If a person makes a bequest for the Banu so-and-so, then men and women will all be equal, unless he says: «لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ»."
