بَابُ مِيرَاثِ السَّائِبَةِChapter on inheritance of a freed slave
Hadith 1403

سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يَحْيَى بْنُ سَعِيدٌ، قَالَ: نا أَبُو بَكْرِ بْنُ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ، أَنَّ امْرَأَةً مِنَ الْحَضَرِ حَضَرِ مُحَارِبٍ أَعْتَقَتْ غُلَامًا لَهَا فَقَالَتْ: انْطَلِقْ فَوَالِ مَنْ شِئْتَ فَانْطَلَقَ الْغُلَامُ فَوَالَى عَبْدَ الرَّحْمَنِ بْنَ مَعْمَرٍ فَمَاتَتِ الْمَرْأَةُ فَخَاصَمَ وَرَثَتُهَا عَبْدَ الرَّحْمَنِ بْنَ مَعْمَرٍ إِلَى عُثْمَانَ بْنِ عَفَّانَ، فَدَعَاهُ فَأَخْبَرَهُ بِالْقَصَّةِ فَقَالَ لَهُ: «انْطَلِقْ فَوَالِ مَنْ شِئْتَ فَرَجَعَ إِلَى عَبْدِ الرَّحْمَنِ فَوَالَاهُ»
A case was brought before Sayyiduna Uthman bin Affan (may Allah be pleased with him) regarding a woman who had freed her slave and said: "Go, choose the guardianship of whomever you wish." The slave went to Sayyiduna Abdur Rahman bin Ma'mar (may Allah be pleased with him) and chose his guardianship. Then the woman passed away, and her heirs disputed with Sayyiduna Abdur Rahman bin Ma'mar (may Allah be pleased with him). Sayyiduna Uthman (may Allah be pleased with him) inquired about the matter, and the slave narrated the entire incident. Sayyiduna Uthman (may Allah be pleased with him) said: "Go, choose the guardianship of whomever you wish." The slave returned to Sayyiduna Abdur Rahman bin Ma'mar (may Allah be pleased with him) and chose his guardianship.
