قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: " فَهُوَ لِلَّذِي فِيُ يَدِهِ مَعَ يَمِينِهِ إِذَا لَمْ تَقُمْ لِوَاحِدٍ مِنْهُمَا بَيِّنَةٌ ".
Imam al-Shafi'i (may Allah have mercy on him) said: "Then it (the item) belongs to the one in whose possession it is, with his oath, when no proof (testimony) is established in favour of either of the two."
