Hadith 4107
نَا نَا أَبُو بَكْرٍ ، نَا بَحْرُ ، نَا ابْنُ وَهْبٍ ، حَدَّثَنِي يَحْيَى بْنُ أَيُّوبَ ، عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ " أَعْطَى الابْنَةَ النِّصْفَ ، وَأَعْطَى الأُخْتَ مَا بَقِيَ " .
Abu Salamah bin Abdur Rahman narrates that Sayyiduna Umar bin Khattab (may Allah be pleased with him) gave the daughter half the share and gave the remaining wealth to __QUR_N__.
Hadith 4108
نَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ ، أنا عُبَيْدُ اللَّهِ بْنُ عُمَرَ الْقَوَارِيرِيُّ ، نَا مُعَاذُ بْنُ هِشَامٍ ، حَدَّثَنِي أَبِي ، عَنْ قَتَادَةَ ، نَا أَبُو حَسَّانَ الأَعْرَجُ ، عَنِ الأَسْوَدِ بْنِ يَزِيدَ الْكُوفِيُّ ، أَنَّ مُعَاذَ بْنَ جَبَلٍ ، " أُتِيَ بِالْيَمَنِ فِي مِيرَاثِ رَجُلٍ تَرَكَ ابْنَتَهُ ، وَأُخْتَهُ ، فَأَعْطَى ابْنَتَهُ النِّصْفَ ، وَأُخْتَهُ النِّصْفَ ، وَرَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حَيُّ بَيْنَ أَظْهُرِهِمْ " .
Aswad bin Yazid Kufi narrates that Sayyiduna Mu'adh bin Jabal (may Allah be pleased with him) distributed the inheritance of a man in Yemen, who had left behind a daughter and a sister among his heirs. Sayyiduna Mu'adh (may Allah be pleased with him) gave half to the daughter and half to the sister. This was at the time when the Prophet Muhammad (peace and blessings be upon him) was present among the people (i.e., during the lifetime of the Prophet Muhammad, peace be upon him).
Hadith 4109
نَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ زِيَادٍ ، نَا مُحَمَّدُ بْنُ غَالِبٍ ، نَا سُلَيْمَانُ بْنُ دَاوُدَ الْمِنْقَرِيُّ ، نَا يَزِيدُ بْنُ زُرَيْعٍ ، نَا سَعِيدٌ ، عَنْ قَتَادَةَ ، عَنْ جَابِرِ بْنِ زَيْدٍ ، عَنِ ابْنِ عَبَّاسٍ ، أَنَّ مَوْلًى لِحَمْزَةَ تُوُفِّيَ ، فَتَرَكَ ابْنَتَهُ ، وَابْنَةَ حَمْزَةَ ، فَأَعْطَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ابْنَتَهُ النِّصْفَ ، وَلابْنَةِ حَمْزَةَ النِّصْفُ " ، هَكَذَا نَاهُ مِنْ أَصْلِهِ بِهَذَا الإِسْنَادِ.
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates that the slave of Sayyiduna Hamza (may Allah be pleased with him) passed away. He left behind a daughter and the daughter of Sayyiduna Hamza (may Allah be pleased with him) among his heirs. So the Prophet Muhammad (peace and blessings be upon him) gave half of the inheritance to the slave’s daughter and half to the daughter of Sayyiduna Hamza (may Allah be pleased with him).
Hadith 4110
نَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ زِيَادٍ ، نَا مُحَمَّدُ بْنُ غَالِبٍ ، نَا عَفَّانُ ، نَا هَمَّامٌ ، نَا قَتَادَةُ ، عَنِ الْحَسَنِ ، عَنْ عِمْرَانَ بْنِ حُصَيْنٍ ، قَالَ : جَاءَ رَجُلٌ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " إِنَّ ابْنَ ابْنِي مَاتَ فَمَا لِي مِنْ مِيرَاثِهِ ؟ ، قَالَ : لَكَ السُّدُسُ ، فَلَمَّا أَدْبَرَ دَعَاهُ ، فَقَالَ : لَكَ سُدُسٌ آخَرُ، فَلَمَّا أَدْبَرَ دَعَاهُ ، فَقَالَ : لَكَ السُّدُسُ الآخَرُ طُعْمَةً " .
Sayyiduna Imran bin Husain (may Allah be pleased with him) narrates that a man came to the Prophet (peace and blessings be upon him) and said: “My son has passed away, what will I receive from his inheritance?” The Prophet (peace and blessings be upon him) said: “You will receive one-sixth.” When he went back, the Prophet (peace and blessings be upon him) called him and said: “You will receive another one-sixth.” When he went back, the Prophet (peace and blessings be upon him) called him and said: “You will receive yet another one-sixth in addition.”
Hadith 4111
نَا مُحَمَّدُ بْنُ سُلَيْمَانَ النُّعْمَانِيُّ ، نَا الْحُسَيْنُ بْنُ عَبْدِ الرَّحْمَنِ الْجَرْجَرَائِيُّ ، نَا وَكِيعٌ ، عَنْ سُفْيَانَ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ عَيَّاشٍ ، عَنْ حَكِيمِ بْنِ حَكِيمِ بْنِ عَبَّادِ بْنِ حُنَيْفٍ ، عَنْ أَبِي أُمَامَةَ بْنِ سَهْلِ بْنِ حُنَيْفٍ ، قَالَ : " رَمَى رَجُلٌ رَجُلا بِسَهْمٍ فَقَتَلَهُ ، وَلَيْسَ لَهُ وَارِثٌ إِلا خَالٌ ، فَكَتَبَ فِي ذَلِكَ أَبُو عُبَيْدَةَ بْنُ الْجَرَّاحِ إِلَى عُمَرَ ، وَكَتَبَ عُمَرُ : إِنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : اللَّهُ وَرَسُولُهُ مَوْلَى مَنْ لا مَوْلَى لَهُ ، وَالْخَالُ وَارِثُ مَنْ لا وَارِثَ لَهُ " .
Sayyiduna Abu Umamah bin Sahl Hanif (may Allah be pleased with him) narrates that a man killed another by shooting an arrow at him. The only heir of the deceased was his maternal uncle. Sayyiduna Abu Ubaidah bin Jarrah (may Allah be pleased with him) wrote to Sayyiduna Umar (may Allah be pleased with him) regarding this matter. Sayyiduna Umar (may Allah be pleased with him) replied in a letter, stating that the Noble Prophet (peace and blessings of Allah be upon him) said: "Whoever has no mawla (patron), Allah and His Messenger are his mawla, and whoever has no heir, then his maternal uncle will be his heir."
Hadith 4112
نَا الْقَاضِي أَحْمَدُ بْنُ إِسْحَاقَ بْنِ بُهْلُولٍ ، نَا زَكَرِيَّا بْنُ يَحْيَى بْنِ زَائِدَةَ أَبُو زَائِدَةَ ، نَا أَبُو عَاصِمٍ ، عَنِ ابْنِ جُرَيْجٍ ، عَنْ عَمْرِو بْنِ مُسْلِمٍ ، عَنْ طَاوُسٍ ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا ، قَالَتْ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِنَّ اللَّهَ مَوْلَى مَنْ لا مَوْلَى لَهُ ، وَالْخَالَ وَارِثُ مَنْ لا وَارِثَ لَهُ " .
Sayyidah Aisha (may Allah be pleased with her) narrates that the Noble Prophet (peace and blessings be upon him) said: “Indeed, whoever has no guardian, Allah is his guardian, and whoever has no heir, his maternal uncle will be his heir.”
Hadith 4113
نَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا مُحَمَّدُ بْنُ يَحْيَى بْنِ فَارِسٍ ، وَأَحْمَدُ بْنُ سَعِيدِ بْنِ صَخْرٍ ، وَأَبُو أُمَيَّةَ الطَّّرَسُوسِيُّ ، قَالُوا : نَا أَبُو عَاصِمٍ ، عَنِ ابْنِ جُرَيْجٍ ، عَنْ عَمْرِو بْنِ مُسْلِمٍ ، عَنْ طَاوُسٍ ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا ، قَالَتْ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " اللَّهُ مَوْلَى مَنْ لا مَوْلَى لَهُ ، وَالْخَالُ وَارِثُ مَنْ لا وَارِثَ لَهُ " .
Lady Aisha (may Allah be pleased with her) narrates that the Noble Prophet (peace and blessings be upon him) said: "Whoever has no guardian, Allah is his guardian, and whoever has no heir, his maternal uncle will be his heir." Lady Aisha (may Allah be pleased with her) says that Allah and His Messenger will be the guardian of the one who has no guardian, and the maternal uncle will be the heir of the one who has no heir.
Hadith 4114
قَالَ قَالَ مُحَمَّدُ بْنُ يَحْيَى ، وَنا أَبُو عَاصِمٍ ، مَرَّةً أُخْرَى عَنِ ابْنِ جُرَيْجٍ ، عَنْ عَمْرِو بْنِ مُسْلِمٍ ، عَنْ طَاوُسٍ ، عَنْ عَائِشَةَ ، قَالَتْ : " اللَّهُ وَرَسُولُهُ مَوْلَى مَنْ لا مَوْلَى لَهُ ، وَالْخَالُ وَارِثُ مَنْ لا وَارِثَ لَهُ " ، فَقِيلَ لأَبِي عَاصِمٍ : عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ؟ فَسَكَتَ فَقَالَ لَهُ الشَّاذَكُونِيُّ : حَدِّثْنَا عَنِ النَّبِي صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَسَكَتَ .
Abu Asim was asked whether this statement is transmitted from the Prophet Muhammad (peace be upon him)? So he remained silent, then Shadh Kuni said to him: "Narrate to us a hadith from the Prophet Muhammad (peace be upon him)." Yet he still remained silent.
Hadith 4115
. نَا ابْنُ مَنِيعٍ ، نَا مُحَمَّدُ بْنُ سِنَانٍ ، نَا أَبُو عَاصِمٍ ، مَوْقُوفًا.
The same narration is transmitted with another chain of narration; however, this narration is "Mawquf" (stopped at a companion).
Hadith 4116
نَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ ، نَا لَيْثُ بْنُ حَمَّادٍ الصَّفَّارُ ، نَا حَمَّادُ بْنُ زَيْدٍ ، عَنْ بُدَيْلِ بْنِ مَيْسَرَةَ ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ ، عَنْ رَاشِدِ بْنِ سَعْدٍ ، عَنْ أَبِي عَامِرٍ الْهَوْزَنِيِّ ، عَنِ الْمِقْدَامِ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " أَنَا أَوْلَى بِكُلِّ مُؤْمِنٍ مِنْ نَفْسِهِ ، مَنْ تَرَكَ مَالا فَلِوَرَثَتِهِ ، وَمَنْ تَرَكَ دَيْنًا أَوْ ضَيَاعًا ، فَإِلَيَّ أَنَا أَقْضِي دَيْنَهُ وَأَفُكُّ عَانِيَهُ ، وَالْخَالُ وَارِثُ مَنْ لا وَارِثَ لَهُ ، يَقْضِي دَيْنَهُ وَيَفُكُّ عَانِيَهُ " ،.
Sayyiduna Miqdad (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: "I am closer to every believer than his own self. Whoever leaves behind wealth, it will go to his heirs, and whoever leaves behind debt or dependents (with no one to care for them), then they should come to me; I will pay off that person's debt and fulfill his other responsibilities. The maternal uncle becomes the heir of the one who has no heir, because he will also pay off his debt and fulfill his responsibilities."
Hadith 4117
نَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ ، نَا الْقَوَارِيرِيُّ ، وَإِسْحَاقُ بْنُ إِبْرَاهِيمَ ، قَالا : نَا حَمَّادُ بْنُ زَيْدٍ ، بِهَذَا الإِسْنَادِ ، قَالَ إِسْحَاقُ : عَنِ الْمِقْدَامِ بْنِ مَعْدِ يكَرِبَ .
The same narration is also transmitted with another chain of narration on the authority of Sayyiduna Miqdam bin Ma'dikarib (may Allah be pleased with him).
Hadith 4118
نَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا عَبْدُ الرَّحْمَنِ بْنُ بِشْرٍ ، نَا عَبْدُ الرَّزَّاقِ ، أنا ابْنُ جُرَيْجٍ ، بِإِسْنَادِهِ مِثْلَهُ مَوْقُوفًا ،.
The same narration is transmitted with another chain as a "Mawquf" narration.
Hadith 4119
حَدَّثَنَا ابْنُ مَنِيعٍ حَدَّثَنَا الْجُرْجَانِىُّ حَدَّثَنَا عَبْدُ الرَّزَّاقِ بِإِسْنَادِهِ مَوْقُوفًا .
The same narration is transmitted with another chain as a "Mawquf" narration.
Hadith 4120
نَا النَّيْسَابُورِيُّ ، نَا أَبُو الأَزْهَرِ ، نَا رَوْحٌ ، عَنِ ابْنِ جُرَيْجٍ ، عَنِ الْحَسَنِ بْنِ مُسْلِمٍ ، عَنْ طَاوُسٍ ، عَنِ ابْنِ عَبَّاسٍ ، عَنْ عَائِشَةَ ، قَالَتْ : " اللَّهُ وَرَسُولُهُ " مِثْلَهُ . قَالَ النَّيْسَابُورِيُّ : أَخْطَأَ فِيهِ رَوْحٌ ، وَالصَّوَابُ عَمْرُو بْنُ مُسْلِمٍ.
This narration is also transmitted with another chain from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) from Sayyidah Aisha (may Allah be pleased with her), in which these words are mentioned: "Allah Almighty and His Messenger (are his protectors)."
Hadith 4121
نَا عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ ، نَا مُحَمَّدُ بْنُ عَبْدِ الْوَهَّابِ ، نَا شَرِيكٌ . ح وثنا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، نَا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ الْجُنَيْدِ ، نَا أَبُو أَحْمَدَ ، نَا شَرِيكٌ ، عَنْ لَيْثٍ ، عَنْ أَبِي هُبَيْرَةَ ، عَنْ أَبِي هُرَيْرَةَ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " الْخَالُ وَارِثُ مَنْ لا وَارِثَ لَهُ " .
Sayyiduna Abu Huraira (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: "Whoever has no heir, his maternal uncle becomes his heir."
Hadith 4122
نَا ابْنُ صَاعِدٍ ، نَا مُحَمَّدُ بْنُ عُمَارَةَ بْنِ صُبَيْحٍ ، نَا أَبُو نُعَيْمٍ ، نَا شَرِيكٌ ، عَنْ لَيْثٍ ، عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ ، عَنْ أَبِي هُرَيْرَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " الْخَالُ وَارِثٌ " .
Sayyiduna Abu Huraira (may Allah be pleased with him) narrates this statement of the Noble Prophet (peace and blessings be upon him): "The maternal uncle becomes an heir."
Hadith 4123
نَا نَا أَبُو عُمَرَ الْقَاضِي ، نَا أَحْمَدُ بْنُ مَنْصُورٍ الرَّمَادِيُّ ، نَا زَيْدُ بْنُ الْحُبَابِ ، نَا الْحُسَيْنُ بْنُ وَاقِدٍ ، عَنْ مَنْصُورٍ ، عَنْ إِبْرَاهِيمَ ، عَنْ عَلْقَمَةَ ، عَنْ عَبْدِ الْمَلِكِ " فِي ابْنَةِ ابْنَةٍ ، وَابْنَةِ أُخْتٍ ، الْمَالُ بَيْنَهُمَا نِصْفَانِ " ، الصَّوَابُ مِنْ قَوْلِ عَلْقَمَةَ.
Alqamah narrated regarding Abdul Malik that when a person has one granddaughter and one niece, the wealth will be divided equally between them; the correct view is that this is Alqamah's own opinion.
