Hadith 4068
نَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ يَزِيدَ الزَّعْفَرَانِيُّ ، نَا مُحَمَّدُ بْنُ حَسَّانَ الأَزْرَقُ ، نَا أَبُو عَامِرٍ ، نَا زَمْعَةُ بْنُ صَالِحٍ ، عَنِ ابْنِ طَاوُسٍ ، عَنْ أَبِيهِ ، عَنِ ابْنِ عَبَّاسٍ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " أَلْحِقُوا الْمَالَ بِالْفَرَائِضِ ، فَمَا تَرَكَتْ فَلأَوْلَى ذَكَرٍ " .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates that the Noble Prophet (peace and blessings be upon him) said: “Distribute the wealth according to the prescribed shares of inheritance, and whatever remains, it will go to the closest male relative.”
Hadith 4069
نَا يُوسُفُ بْنُ يَعْقُوبَ بْنِ إِسْحَاقَ بْنِ بُهْلُولٍ ، وَأَبُو عِيسَى مُحَمَّدُ بْنُ أَحْمَدَ بْنِ قَطَنٍ ، قَالا : نَا أَحْمَدُ بْنُ مَنْصُورٍ ح وَنا أَبُو شَيْبَةَ عَبْدُ الْعَزِيزِ بْنُ جَعْفَرٍ ، نَا مُحَمَّدُ بْنُ مَسْعُودٍ الْعَجَمِيُّ ، قَالا : نَا عَبْدُ الرَّزَّاقِ ، أنا مَعْمَرٌ ، عَنِ ابْنِ طَاوُسٍ ، عَنْ أَبِيهِ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَقْسِمُوا الْمَالَ بَيْنَ أَهْلِ الْفَرَائِضِ ، فَمَا تَرَكَتِ الْفَرَائِضُ فَلأَوْلَى رَجُلٍ ذَكَرٍ " ، وَقَالَ أَبُو شَيْبَةَ : " أَقْسِمُوا الْمِيرَاثَ بَيْنَ أَهْلِ الْفَرَائِضِ عَلَى كِتَابِ اللَّهِ تَعَالَى ".
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates that the Noble Prophet (peace and blessings be upon him) said: "Distribute the wealth among the heirs entitled to fixed shares. Whatever remains after the fixed shares, it will go to the closest male relative." Abu Shaybah has narrated these words: "Distribute the inheritance among the possessors of fixed shares according to the command of Allah's Book."
Hadith 4070
نَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ إِبْرَاهِيمَ ، نَا مُعَاذُ بْنُ الْمُثَنَّى ، نَا مُحَمَّدُ بْنُ الْمِنْهَالِ ، نَا يَزِيدُ بْنُ زُرَيْعٍ ، نَا رَوْحُ بْنُ الْقَاسِمِ ، عَنْ عَبْدِ اللَّهِ بْنِ طَاوُسٍ ، عَنْ أَبِيهِ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَلْحِقُوا الْفَرَائِضَ بِأَهْلِهَا ، فَمَا تَرَكَتِ فَلأَوْلَى رَجُلٍ ذَكَرٍ " .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates that the Noble Prophet (peace and blessings be upon him) said: "Give the prescribed shares to those who are entitled to them, and whatever remains, it is for the nearest male relative."
Hadith 4071
نَا عَلِيُّ بْنُ عَبْدِ اللَّهِ بْنِ مُبَشِّرٍ ، نَا أَحْمَدُ بْنُ سِنَانٍ ، نَا مُحَمَّدُ بْنُ أَبِي نُعَيْمٍ . ح وَنا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ سَعْدَانَ ، نَا سَعِيدُ بْنُ أَيُّوبَ ، نَا مُسْلِمٌ ، قَالا : نَا وُهَيْبٌ ، نَا عَبْدُ اللَّهِ بْنُ طَاوُسٍ ، عَنْ أَبِيهِ ، عَنِ ابْنِ عَبَّاسٍ ، عَن النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " أَلْحِقُوا الْفَرَائِضَ بِأَهْلِهَا ، فَمَا بَقِيَ فَهُوَ لأَوْلَى رَجُلٍ ذَكَرٍ " .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates this statement of the Noble Prophet (peace and blessings be upon him): "Give the prescribed shares to those who are entitled to them, and whatever remains, it will go to the nearest male relative."
Hadith 4072
نَا عَبْدُ الْبَاقِي بْنُ قَانِعٍ ، نَا عَلِيُّ بْنُ عَبْدِ الصَّمَدِ الطَّيَالِسِيُّ ، نَا خَالِدُ بْنُ يُوسُفَ السَّمْتِيُّ ، حَدَّثَنِي أَبِي ، عَنْ زِيَادِ بْنِ سَعْدٍ ، سَمِعَ ابْنَ طَاوُسٍ ، قَالَ : سَمِعْتُ طَاوُسًا ، يَقُولُ : قَالَ ابْنُ عَبَّاسٍ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَلْحِقُوا الْمَالَ بِالْفَرَائِضِ ، فَمَا تَرَكَتْ فَلأَوْلَى رَحِمٍ ذَكَرٍ " .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings be upon him) said: "Distribute the wealth according to the prescribed shares, and whatever remains, it will go to the closest male relative."
Hadith 4073
نَا عُمَرُ بْنُ الْحَسَنِ بْنِ عَلِيٍّ الشَّيْبَانِيُّ ، نَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ بَكْرٍ ، نَا هِشَامُ بْنُ خَالِدٍ ، نَا مَرْوَانُ بْنُ مُحَمَّدٍ ، نَا سُفْيَانُ ، عَنْ هِشَامِ بْنِ حُجَيْرٍ ، عَنْ طَاوُسٍ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَلْحِقُوا الْمَالَ بِالْفَرَائِضِ ، فَمَا أَبْقَتْ فَلأَوْلَى رَحِمٍ ذَكَرٍ " .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings be upon him) said: "Distribute the wealth according to the prescribed shares, and whatever remains, it will go to the closest male relative."
Hadith 4074
نَا مُحَمَّدُ بْنُ جَعْفَرٍ الْمَطِيرِيُّ ، نَا إِسْمَاعِيلُ بْنُ عَبْدِ اللَّهِ بْنِ مَيْمُونٍ ، نَا عُبَيْدُ اللَّهِ بْنُ مُوسَى ، نَا حَسَنُ بْنُ صَالِحٍ ، عَنْ مُحَمَّدِ بْنِ سَعِيدٍ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، أَخْبَرَنِي أَبِي ، عَنْ جَدِّي عَبْدِ اللَّهِ بْنِ عَمْرٍو ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " قَامَ يَوْمَ فَتْحِ مَكَّةَ ، فَقَالَ : لا يَتَوَارَثُ أَهْلُ مِلَّتَيْنِ ، وَالْمَرْأَةُ تَرِثُ مِنْ دِيَةِ زَوْجِهَا وَمَالِهِ ، وَهُوَ يَرِثُ مِنْ دِيَتِهَا وَمَالِهَا ، مَا لَمْ يَقْتُلْ أَحَدُهُمَا صَاحِبَهُ عَمْدًا ، فَإِنْ قَتَلَ أَحَدُهُمَا صَاحِبَهُ عَمْدًا ، لَمْ تَرِثْ مِنْ دِيَتِهِ وَمَالِهِ شَيْئًا ، وَإِنْ قَتَلَ صَاحِبَهُ خَطَأً وَرِثَ مِنْ مَالِهِ وَلَمْ تَرِثْ مِنْ دِيَتِهِ " ، مُحَمَّدُ بْنُ سَعِيدٍ الطَّائِفِيُّ ثِقَةٌ .
Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) narrates: On the day of the conquest of Makkah, the Noble Prophet (peace and blessings be upon him) stood up and said: "People belonging to two different religions will not inherit from each other. A woman will inherit from her husband's blood money (diyah) and his wealth, and the man will also inherit from the woman's blood money and her wealth, but the condition is that neither of them has intentionally killed the other. If either of them has intentionally killed the other, then that woman will not inherit anything from that man's blood money or wealth. And if either of them has killed the other by mistake, then he (or she) will inherit from the other's wealth, but will not inherit from the blood money." The narrator of this narration, Muhammad bin Sa'id Ta'ifi, is trustworthy.
Hadith 4075
نَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا مُحَمَّدُ بْنُ يَحْيَى ، نَا عُبَيْدُ اللَّهِ بْنُ مُوسَى ، أنا الْحَسَنُ بْنُ صَالِحٍ ، بِإِسْنَادِهِ مِثْلَهُ . مُحَمَّدُ بْنُ سَعِيدٍ الطَّائِفِيُّ ثِقَةٌ.
This narration is also transmitted with another chain of transmission.
Hadith 4076
ثنا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا بَحْرُ بْنُ نَصْرٍ ، نَا ابْنُ وَهْبٍ ، أَخْبَرَنِي سُفْيَانُ الثَّوْرِيُّ ، عَنْ دَاوُدَ بْنِ أَبِي هِنْدَ ، عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ ، " أَنَّهُ كَانَ لا يُوَرِّثُ مَيِّتًا مِنْ مَيِّتٍ ، وَيُوَرِّثُ الأَحْيَاءَ مِنَ الأَمْوَاتِ " .
Umar bin Abdul Aziz narrates that he did not consider a deceased person to be the heir of another deceased person; he only considered living individuals to be the heirs of the deceased.
Hadith 4077
وَأَخْبَرَنِي وَأَخْبَرَنِي سُفْيَانُ الثَّوْرِي ، عَنُ أَبِي الزِّنَادِ ، قَالَ : " قُسِمَتْ مَوَارِيثُ أَصْحَابِ الْحَرَّةِ ، فَوَرِثَ الأَحْيَاءُ مِنَ الأَمْوَاتِ ، وَلَمْ يَرِثِ الأَمْوَاتُ مِنَ الأَمْوَاتِ " .
Abu al-Zinad narrates: During the incident of Harrah, the inheritance of those who were killed was distributed, and the living people were made heirs of the deceased, but the deceased were not made heirs of one another.
Hadith 4078
حَدَّثَنَا أَبُو بَكْرٍ ، نَا بَحْرُ ، نَا ابْنُ وَهْبٍ ، أَخْبَرَنِي عَبْدُ اللَّهِ بْنُ عُمَرَ بْنِ حَفْصٍ ، " أَنَّ أُمَّ كُلْثُومٍ وَابْنَهَا زَيْدَ بْنَ عُمَرَ بْنِ الْخَطَّابِ ، هَلَكَا فِي سَاعَةٍ وَاحِدَةٍ ، لَمْ يُدْرَ أَيُّهُمَا هَلَكَ قَبْلُ ، فَلَمْ يَتَوَارَثَا " .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates: A woman named Umm Kulthum and her son Zaid, who was the son of Sayyiduna Umar (may Allah be pleased with him), both passed away at the same time, but it could not be determined which of them died first. Therefore, they did not inherit from each other.
Hadith 4079
حَدَّثَنَا حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ سَعِيدِ الْمُقْرِئُ ، نَا يَعْقُوبُ الدَّوْرَقِيُّ ، نَا رَوْحُ بْنُ عُبَادَةَ ، نَا زَكَرِيَّا بْنُ إِسْحَاقَ ، عَنْ عَمْرِو بْنِ دِينَارٍ ، عَنْ أَبِي الْمِنْهَالِ ، عَنْ إِيَاسِ بْنِ عَبْدٍ ، وَلَهُ صُحْبَةٌ " أَنَّ قَوْمًا وَقَعَ عَلَيْهِمْ بَيْتٌ ، فَوَرِثَ بَعْضُهُمْ مِنْ بَعْضٍ " .
Iyas bin Abd reports that a house collapsed on some people, so they were made heirs of one another.
Hadith 4080
نَا نَا مُحَمَّدُ بْنُ حَمْدَوَيْهِ ، نَا مَحْمُودُ بْنُ آدَمَ ، نَا سُفْيَانُ ، عَنْ عَمْرٍو ، عَنْ أَبِي الْمِنْهَالِ ، عَنْ إِيَاسِ بْنِ عَبْدٍ ، أَنَّهُ سُئِلَ " عَنْ بَيْتٍ سَقَطَ عَلَى نَاسٍ فَمَاتُوا ، فَقَالَ : يُوَرَّثُ بَعْضُهُمْ مِنْ بَعْضٍ " .
It is narrated about Iyas bin Abd that he was asked regarding a house that collapses upon people and they die, so he said: "They will inherit from one another."
Hadith 4081
حَدَّثَنَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا يُونُسُ بْنُ عَبْدِ الأَعْلَى ، نَا عَبْدُ اللَّهِ بْنُ وَهْبٍ ، أَخْبَرَنِي مُحَمَّدُ بْنُ عَمْرٍو ، عَنِ ابْنِ جُرَيْجٍ ، عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرٍ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لا يَرِثُ الْمُسْلِمُ النَّصْرَانِيَّ ، إِلا أَنْ يَكُونَ عَبْدَهُ أَوْ أَمَتَهُ " .
Sayyiduna Jabir (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) said: "No Muslim can inherit from a Christian, except if he (the Christian) is his (the Muslim's) slave or slave-girl (then he may inherit from him/her)."
Hadith 4082
نَا نَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا عَبْدُ الرَّحْمَنِ بْنُ بِشْرٍ ، وَأَبُو الأَزْهَرِ ، قَالا : نَا عَبْدُ الرَّزَّاقِ ، أنا ابْنُ جُرَيْجٍ ، أَخْبَرَنِي أَبُو الزُّبَيْرِ ، عَنْ جَابِرٍ ، قَالَ : " لا يَرِثُ الْيَهُودِيُّ وَلا النَّصْرَانِيُّ الْمُسْلِمَ ، وَلا يَرِثُهُمْ ، إِلا أَنْ يَكُونَ عَبْدَ الرَّجُلِ أَوْ أَمَتِهِ " ، مَوْقُوفٌ ، وَهُوَ الْمَحْفُوظُ.
Sayyiduna Jabir (may Allah be pleased with him) reports: "No Jew or Christian can inherit from a Muslim, and a Muslim will not inherit from those people. However, if the Jew or Christian is (the Muslim's) slave or his slave-girl, (then the ruling will be different)."
Hadith 4083
نَا عَلِيُّ بْنُ مُحَمَّدِ بْنِ يَحْيَى بْنِ مِهْرَانَ السَّوَّاقُ ، نَا أَبُو النَّصْرِ الْفَقِيهُ إِسْمَاعِيلُ بْنُ عَبْدِ اللَّهِ بْنِ مَيْمُونٍ ، نَا أَبُو غَسَّانَ ، نَا شَرِيكٌ ، عَنْ أَشْعَثَ ، عَنِ الْحَسَنِ ، عَنْ جَابِرٍ ، رَفَعَهُ ، قَالَ : " لا نَرِثُ أَهْلَ الْكِتَابِ وَلا يَرِثُونَا ، إِلا أَنْ يَرِثَ الرَّجُلُ عَبْدَهُ أَوْ أَمَتَهُ ، وَتَحِلُّ لَنَا نِسَاؤُهُمْ ، وَلا تَحِلُّ لَهُمْ نِسَاؤُنَا " .
Sayyiduna Jabir (may Allah be pleased with him) narrates as a marfu’ hadith that (the Noble Prophet, peace and blessings be upon him, said): “We cannot inherit from the People of the Book, nor can they inherit from us. However, a person can inherit from his (slave or bondwoman) who is related to the People of the Book. Their women are lawful for us (to marry), but our women are not lawful for them (to marry).”
Hadith 4084
نَا مُحَمَّدُ بْنُ الْفَتْحِ الْقَلانِسِيُّ ، نَا أَحْمَدُ بْنُ عُبَيْدٍ ، نَا مُحَمَّدُ بْنُ عُمَرَ ، نَا الضَّحَّاكُ بْنُ عُثْمَانَ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لا يَتَوَارَثُ أَهْلُ مِلَّتَيْنِ شَتَّى مُخْتَلِفَتَيْنِ ، قَالَ : وَالْمَرْأَةُ تَرِثُ مِنْ عَقْلِ زَوْجِهَا وَمَالِهِ ، وَهُوَ يَرِثُ مِنْ عَقْلِهَا وَمَالِهَا ، إِلا أَنْ يَقْتُلَ أَحَدُهُمَا صَاحِبَهُ ، فَإِنْ هُوَ قَتَلَهُ عَمْدًا لَمْ تَرِثْ مِنْ مَالِهِ وَلا مِنْ دِيَتِهِ شَيْئًا ، فَإِنْ قَتَلَ خَطَأً وَرِثَ مِنْ مَالِهِ ، وَلَمْ تَرِثْ مِنْ دِيَتِهِ شَيْئًا " ،.
Amr bin Shu'aib narrates from his father, from his grandfather: The Prophet Muhammad (peace be upon him) said: "People belonging to different religions cannot inherit from one another." He also said: "A woman will inherit from her husband's blood money (diyah) and his wealth, and the man will inherit from this woman's blood money and her wealth. However, if one of them kills the other, then if he has intentionally killed his partner, he will not inherit from his wealth nor from the blood money. But if the deceased was killed by mistake, then (the other party) will inherit from his wealth, but will not inherit anything from the blood money."
Hadith 4085
نَا مُحَمَّدُ بْنُ الْفَتْحِ الْقَلانِسِيُّ ، نَا أَحْمَدُ بْنُ عُبَيْدٍ ، نَا مُحَمَّدُ بْنُ عُمَرَ ، نَا مَخْرَمَةُ بْنُ بُكَيْرٍ ، عَنْ أَبِيهِ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِثْلَهُ.
The same narration is also transmitted with another chain from Amr bin Shu'aib, from his father, from his grandfather, from the Prophet (peace and blessings be upon him), in a similar manner.
Hadith 4086
نَا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ الْحَسَنِ ، نَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ بْنِ أَبِي حَسَّانَ ، نَا عَبْدُ الرَّحْمَنِ بْنُ إِبْرَاهِيمَ ، نَا الْوَلِيدُ ، نَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الشُّعَيْثِيُّ ، عَنْ زُفَرَ بْنِ وَثِيمَةَ ، عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، " كَتَبَ إِلَى الضَّحَّاكِ بْنِ سُفْيَانَ ، أَنْ يُوَرِّثَ امْرَأَةَ أَشْيَمَ الضِّبَابِيِّ مِنْ دِيَتِهِ " ،.
Sayyiduna Mughirah bin Shu'bah (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) wrote in a letter to Sayyiduna Dahhak bin Sufyan (may Allah be pleased with him) that he should consider the wife of Sayyiduna Ashim Dhibabi as an heir from her husband's blood money.
Hadith 4087
نَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْفَارِسِيُّ ، نَا مُحَمَّدُ بْنُ إِبْرَاهِيمَ الصُّورِيُّ ، نَا خَالِدُ بْنُ عَبْدِ الرَّحْمَنِ ، نَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الشُّعَيْثِيُّ ، عَنْ زُفَرَ بْنِ وَثِيمَةَ ، عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ ، أَنَّ زُرَارَةَ بْنَ جُزِيٍّ أَوْ حَزْنٍ - شَكَّ الصُّورِيُّ - قَالَ لِعُمَرَ بْنِ الْخَطَّابِ : إِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " كَتَبَ إِلَى الضَّحَّاكِ بْنِ سُفْيَانَ أَنْ يُوَرِّثَ " مِثْلَهُ . وَرَوَاهُ زُهَيْرُ بْنُ هِنْدَ ، عَنِ الشَّعْبِيِّ ، عَنْ مَكْحُولٍ ، عَنْ زُرَارَةَ بْنِ جُزِيٍّ ، عَنِ الْمُغِيرَةِ فَذَكَرَهُ.
It is narrated about Sayyiduna Mughirah bin Shu'bah, may Allah be pleased with him, that he states: Zararah bin Juza' or perhaps Harn said to Sayyiduna Umar bin Khattab, may Allah be pleased with him, that the Noble Prophet, peace and blessings be upon him, had written to Sayyiduna Dahiq bin Sufyan in a letter that he should consider him an heir. After that, the narration continues as previously mentioned. This narration has also been transmitted by other narrators.
Hadith 4088
نَا نَا جَعْفَرُ بْنُ مُحَمَّدِ بْنِ نُصَيْرٍ ، نَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ سُلَيْمَانَ الْحَضْرَمِيُّ ، نَا عَبْدُ اللَّهِ بْنُ عُمَرَ ، نَا ابْنُ الْمُبَارَكِ ، عَنِ الزُّهْرِيِّ ، عَنْ أَنَسٍ ، قَالَ : " كَانَ قَتْلُ أَشْيَمَ خَطَأً " .
Sayyiduna Anas (may Allah be pleased with him) narrates: Sayyiduna Ashim was killed by mistake.
Hadith 4089
نَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، نَا خَلَفُ بْنُ مُحَمَّدٍ الْوَاسِطِيُّ ، نَا يَزِيدُ بْنُ هَارُونَ ، أنا يَحْيَى بْنُ سَعِيدٍ ، أَنَّ مُحَمَّدَ بْنَ مُسْلِمٍ أَخْبَرَهُ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ ، قَامَ فَسَأَلَ : " هَلْ أَحَدٌ عَلِمَ بِقَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي مِيرَاثِ الْمَرْأَةِ مِنْ عَقْلِ زَوْجِهَا ؟ ، فَقَالَ الضَّحَّاكُ بْنُ سُفْيَانَ : أَنَا عِنْدِي فِي ذَلِكَ عِلْمٌ ، قَدْ كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَتَبَ إِلَيْنَا أَنْ نُوَرِّثَ امْرَأَةَ أَشْيَمَ الضِّبَابِيِّ مِنْ عَقْلِ زَوْجِهَا أَشْيَمَ " ،.
Saeed bin Musayyib (may Allah have mercy on him) narrates: Sayyiduna Umar bin Khattab (may Allah be pleased with him) stood up and inquired, "Does anyone among you have knowledge regarding whether the Prophet Muhammad (peace and blessings be upon him) made any decision about a woman's inheritance from the blood money (diyah) of her murdered husband?" Upon this, Sayyiduna Dahiak bin Sufyan (may Allah be pleased with him) said: "I have knowledge about this. The Prophet Muhammad (peace and blessings be upon him) wrote us a letter instructing us to give the wife of Ashyam Dhibabi a share from the blood money (diyah) of her husband Ashyam."
Hadith 4090
نَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْفَارِسِيُّ ، نَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ ، نَا عَبْدُ الرَّزَّاقِ ، عَنْ مَعْمَرٍ ، وَابْنِ جُرَيْجٍ ، عَنِ ابْنِ شِهَابٍ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، أَنَّ عُمَرَ، قَالَ : " مَا أَرَى الدِّيَةَ إِلا لِلْعَصَبَةِ ، لأَنَّهُمْ يَعْقِلُونَ عَنْهُ ، فَهَلْ سَمِعَ مِنْكُمْ أَحَدٌ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ؟ ثَمَّ ذَكَرَ نَحْوَهُ . وَقَالَ : فَأَخَذَ بِذَلِكَ عُمَرُ ، زَادَ ابْنُ جُرَيْجٍ : وَكَانَ قَتْلُهُ خَطَأً .
Saeed bin Musayyib (may Allah have mercy on him) narrates: Sayyiduna Umar bin Khattab (may Allah be pleased with him) said: "I think that the blood money (diyah) should only be given to the 'asaba (male agnate relatives), because they are the ones who pay the diyah as well." Has any one of you heard anything about this from the tongue of the Prophet (peace and blessings be upon him)? After this, the narrator has transmitted the hadith as previously mentioned, and in it are also these words: that Sayyiduna Umar bin Khattab (may Allah be pleased with him) gave a verdict according to this. The narrator named Ibn Jurayj has transmitted these additional words: "He was killed by mistake."
Hadith 4091
نَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ الْجَرَّاحِ ، نَا يُوسُفُ بْنُ سَعِيدٍ ، نَا حَجَّاجٌ ، عَنِ ابْنِ جُرَيْجٍ ، قَالَ : قَالَ ابْنُ شِهَابٍ : حَدَّثَنِي سَعِيدُ بْنُ الْمُسَيِّبِ ، أَنَّ عُمَرَ، كَانَ يَقُولُ : الدِّيَةُ لِلْعَاقِلَةِ ، وَلا تَرِثُ الْمَرْأَةُ مِنْ دِيَةِ زَوْجِهَا شَيْئًا ، حَتَّى قَالَ الضَّحَّاكُ بْنُ سُفْيَانَ : كَتَبَ إِلَيَّ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِثْلَهُ.
Saeed bin Musayyib (may Allah have mercy on him) narrates that Sayyiduna Umar bin Khattab said: "The blood money will go to the family members, and a woman will not inherit anything from her husband's blood money." Until Sayyiduna Dahiya bin Sufyan (may Allah be pleased with him) informed him that the Prophet Muhammad (peace and blessings be upon him) had written this letter to me (after which the narration continues as previously mentioned).
Hadith 4092
نَا نَا عَلِيُّ بْنُ مُحَمَّدٍ الْمِصْرِيُّ ، نَا مَالِكُ بْنُ يَحْيَى ، نَا عَلِيُّ بْنُ عَاصِمٍ ، عَنْ مُحَمَّدِ بْنِ سَالِمٍ ، عَنْ عَامِرٍ ، عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ ، قَالَ : " الدِّيَةُ تُقْسَمُ عَلَى فَرَائِضِ اللَّهِ فَيَرِثُ مِنْهَا كُلُّ وَارِثٍ " .
Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) said: "The blood money will be distributed according to the obligations prescribed by Allah, and the heir will take his share from it."
Hadith 4093
نَا يَحْيَى بْنُ مُحَمَّدِ بْنِ صَاعِدٍ ، نَا أَبُو الأَشْعَثِ أَحْمَدُ بْنُ الْمِقْدَامِ ، نَا بِشْرُ بْنُ الْمُفَضَّلِ ، نَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ عَقِيلٍ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ، قَالَ : خَرَجْنَا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، حَتَّى جِئْنَا امْرَأَةً بِالأَسْوَافِ وَهِيَ جَدَّةُ خَارِجَةَ بْنِ زَيْدِ بْنِ ثَابِتٍ فَزُرْنَاهَا ذَلِكَ الْيَوْمَ فَرَشَّتْ لَنَا صُوَرًا فَقَعَدْنَا تَحْتَهُ بَيْنَ نَخْلٍ ، وَذَبَحَتْ لَنَا شَاةً ، وَعَلَّقْتُ لَنَا قِرْبَةً مِنْ مَاءٍ ، فَبَيْنَمَا نَحْنُ نَتَحَدَّثُ جَاءَتِ امْرَأَةٌ بِابْنَتَيْنِ لَهَا ، فَقَالَتْ : يَا رَسُولَ اللَّهِ ، " هَاتَانِ ابْنَتَا ثَابِتِ بْنِ قَيْسٍ ، أَوْ قَالَتْ : سَعْدِ بْنِ الرَّبِيعِ ، قُتِلَ مَعَكَ يَوْمَ أُحُدٍ ، وَقَدِ اسْتَفَاءَ عَمُّهُمَا مَالَهُمَا وَمِيرَاثَهُمَا كُلَّهُ فَلَمْ يَدَعْ لَهُمَا مَالا إِلا أَخَذَهُ ، فَمَا تَرَى يَا رَسُولَ اللَّهِ ؟ فَوَاللَّهِ مَا تُنْكَحَانِ أَبَدًا إِلا وَلَهُمَا مَالٌ ، قَالَ : فَقَالَ : يَقْضِي اللَّهُ فِي ذَلِكَ ، فنزلت سُورَةُ النِّسَاءِ وَفِيهَا يُوصِيكُمُ اللَّهُ فِي أَوْلادِكُمْ لِلذَّكَرِ مثل حَظِّ الأُنْثَيَيْنِ سورة النساء آية 11 ، فَقَالَ لِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : ادْعُوا لِي الْمَرْأَةَ وَصَاحِبَهَا ، فَقَالَ لِعَمِّهَا : أَعْطِهِمَا الثُّلُثَيْنِ ، وَأَعْطِ أُمَّهُمَا الثُّمُنَ ، وَمَا بَقِيَ فَلَكَ " .
Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them) narrates that once we were on a journey with the Prophet Muhammad (peace be upon him) until we reached the place of Aswaf, where we came to a woman who was the grandmother of Kharijah bin Zaid. We stayed with her that day. She spread a cloth for us and we sat on it under a date-palm tree. The woman had a goat slaughtered for us and brought a water-skin and placed it there. During this time, we continued to converse. Meanwhile, a woman came, bringing her two daughters, and said: O Messenger of Allah! These are the daughters of Thabit bin Qais (the narrator is unsure, perhaps these are the words) or the daughters of Sa‘id bin Rabi‘, who was martyred with you in the Battle of Uhud. Their uncle has taken their wealth and inheritance into his possession. He has left nothing for them; he has taken it all. O Messenger of Allah! What is your opinion regarding this? By Allah! These two cannot be married off until they have some wealth. So the Prophet Muhammad (peace be upon him) said: “Allah will decide about this.” Then the verse from Surah An-Nisa was revealed in which it is commanded: “Allah commands you concerning your children: for the male, a portion equal to that of two females.” Then the Prophet Muhammad (peace be upon him) said to me: “Bring that woman to me and bring the other party as well.” Then the Prophet Muhammad (peace be upon him) said to the guardian of those girls: “Give these girls two-thirds of the wealth, and give their mother one-eighth, and whatever remains will be yours.”
Hadith 4094
نَا عَلِيُّ بْنُ مُحَمَّدٍ الْمِصْرِيُّ ، نَا رَوْحُ بْنُ الْفَرَجِ أَبُو الزِّنْبَاعِ ، أنا عَبْدُ الْغَنِيِّ بْنُ رِفَاعَةَ ، نَا أَيُّوبُ بْنُ سُلَيْمٍ الأَعْوَرُ ، نَا بِشْرُ بْنُ الْمُفَضَّلِ ، عَنْ عَبْدِ اللَّهِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ ، عَنْ جَابِرٍ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " جَعَلَ لِلْمَرْأَةِ الثُّمُنَ ، وَلِلابْنَتَيْنِ الثُّلُثَيْنِ ، وَمَا بَقِيَ فَلِلأَخِ مِنَ الأَبِ وَالأُمِّ " ، .
Sayyiduna Jabir (may Allah be pleased with him) reports: The Noble Prophet (peace and blessings be upon him) allotted one-eighth for the wife, two-thirds for the two daughters, and the remaining wealth for the full brother.
Hadith 4095
نَا عَلِيُّ بْنُ مُحَمَّدٍ الْمِصْرِيُّ ، نَا الْحَسَنُ بْنُ عَلِيِّ بْنِ الأَشْعَثِ ، نَا مُحَمَّدُ بْنُ يَحْيَى بْنِ سَلامٍ ، حَدَّثَنِي أَبِي ، نَا فُرَاتُ بْنُ سُلَيْمَانَ ، عَنِ ابْنِ عَقِيلٍ ، عَنْ جَابِرٍ ، قَالَ : جَاءَتِ امْرَأَةُ سَعْدِ بْنِ الرَّبِيعِ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَتْ : يَا رَسُولَ اللَّهِ ، إِنَّ سَعْدًا قُتِلَ مَعَكَ شَهِيدًا ، فَذَكَرَ الْحَدِيثَ . وَقَالَ : فَأَرْسَلَ إِلَى عَمِّهَا : " أَعْطِ هَاتَيْنِ الثُّلُثَيْنِ ، وَالْمَرْأَةَ الثُّمُنَ ، وَلَكَ مَا بَقِيَ ".
Sayyiduna Jabir (may Allah be pleased with him) narrates that the wife of Sayyiduna Sa’d bin Rabi’ (may Allah be pleased with him) came to the service of the Prophet (peace and blessings be upon him) and said: “O Messenger of Allah! Sayyiduna Sa’d (may Allah be pleased with him) was martyred with you.” (After this, the narrator mentioned the entire hadith, in which these words are found): The Prophet (peace and blessings be upon him) called the uncle of those two girls and said: “Give two-thirds to these two girls, give one-eighth to the wife, and whatever remains will be for you.”
Hadith 4096
نَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا بَحْرُ بْنُ نَصْرٍ ، ثنا ابْنُ وَهْبٍ ، أَخْبَرَنِي دَاوُدُ بْنُ قَيْسٍ ، وَيَزِيدُ بْنُ عِيَاضٍ ، عَنْ عَبْدِ اللَّهِ بْنِ مُحَمَّدِ بْنِ عَقِيلِ بْنِ أَبِي طَالِبٍ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ، أَنَّ امْرَأَةَ سَعْدِ بْنِ الرَّبِيعِ ، قَالَتْ : يَا رَسُولَ اللَّهِ ، " إِنَّ سَعْدًا هَلَكَ ، وَتَرَكَ ابْنَتَيْنِ ، وَأَخَاهُ ، فَعَمَدَ أَخُوهُ فَقَبَضَ مَا تَرَكَ سَعْدٌ ، وَإِنَّمَا تُنْكَحُ النِّسَاءُ عَلَى أَمْوَالِهِنَّ ، فَلَمْ يُجِبْهَا فِي مَجْلِسِهِ ذَلِكَ ثُمَّ جَاءَتْهُ ، فَقَالَتْ : يَا رَسُولَ اللَّهِ ، ابْنَتَا سَعْدٍ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : ادْعُ لِي أَخَاهُ ، فَجَاءَ ، فَقَالَ : ادْفَعْ إِلَى ابْنَتَيْهِ الثُّلُثَيْنِ ، وَإِلَى امْرَأَتِهِ الثُّمُنَ ، وَلَكَ مَا بَقِيَ " .
Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) narrates that the wife of Sayyiduna Sa’d bin Rabi’ (may Allah be pleased with him) submitted: “O Messenger of Allah! Sayyiduna Sa’d (may Allah be pleased with him) has passed away. He has left behind two daughters and a brother. His brother has taken all the wealth left by Sayyiduna Sa’d (may Allah be pleased with him) into his possession. Women are to be married according to their financial status.” The Prophet (peace and blessings of Allah be upon him) did not give any answer to this woman during that gathering. Then she came to your service again and submitted: “O Messenger of Allah! It is about the two daughters of Sayyiduna Sa’d (may Allah be pleased with him).” The Prophet (peace and blessings of Allah be upon him) said: “Call his brother to me.” That person came, so the Prophet (peace and blessings of Allah be upon him) said: “Give his daughters two-thirds share, and give his wife one-eighth share, and whatever remains, that will be for you.”
Hadith 4097
قُرِئَ عَلَى ابْنِ صَاعِدٍ ، وَأَنَا أَسْمَعُ ، حَدَّثَكُمْ مُحَمَّدُ بْنُ عَبْدِ الْمَلِكِ بْنِ زَنْجُوَيْهِ ، نَا يَزِيدُ بْنُ هَارُونَ ، أنا سُفْيَانُ الثَّوْرِيُّ ، عَنْ أَبِي قَيْسٍ ، عَنْ هُزَيْلِ بْنِ شُرَحْبِيلَ ، قَالَ : أَتَى رَجُلٌ أَبَا مُوسَى الأَشْعَرِيَّ ، وَسَلْمَانَ بْنَ رَبِيعَةَ ، فَسَأَلَهُمَا عَنِ ابْنَةٍ ، وَابْنَةِ ابْنٍ ، وَأُخْتٍ لأَبٍ ، وَأُمٍّ ، فَقَالا : لِلابْنَةِ النِّصْفُ ، وَلِلأُخْتِ مَا بَقِيَ ، وَقَالا : " انْطَلِقْ إِلَى عَبْدِ اللَّهِ ، فَاسْأَلْهُ فَإِنَّهُ سَيُتَابِعُنَا ، فَأَتَى عَبْدَ اللَّهِ ، فَسَأَلَهُ فَأَخْبَرَهُ بِمَا قَالا ، قَالَ : وَلَكِنِّي أَقْضِي فِيهَا كَمَا قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : النِّصْفُ لِلابْنَةِ ، وَلابْنَةِ الابْنِ السُّدُسُ تَكْمِلَةُ الثُّلُثَيْنِ ، وَلِلأُخْتِ مَا بَقِيَ " ،.
Huzail bin Shurahbil narrates: A man came to Sayyiduna Abu Musa Ash'ari (may Allah be pleased with him) and Salman bin Rabiah (may Allah be pleased with him), and he asked both of them about the inheritance ruling for a daughter, a granddaughter, and a full sister. Both of them said: "The daughter will receive half, and the remainder will go to the sister." Then both of them said: "Go to Sayyiduna Abdullah and ask him about this; he will also answer according to our opinion." The man went to Sayyiduna Abdullah, asked him about this, and also informed him of the answer given by the two. Sayyiduna Abdullah (may Allah be pleased with him) said: "I will give the ruling in this matter as the Noble Prophet (peace and blessings be upon him) gave: half will go to the daughter, one-sixth to the granddaughter, so that two-thirds are completed, and the remainder will go to the sister."
Hadith 4098
نَا مُحَمَّدُ بْنُ سُلَيْمَانَ النُّعْمَانِيُّ ، نَا الْحُسَيْنُ بْنُ عَبْدِ الرَّحْمَنِ الْجَرْجَرَائِيُّ ، نَا وَكِيعٌ ، عَنْ سُفْيَانَ ، عَنْ أَبِي قَيْسٍ الأَوْدِيِّ ، بِإِسْنَادِهِ نَحْوَهُ .
This narration is also transmitted with another chain of transmission.
Hadith 4099
قُرِئَ عَلَى ابْنِ صَاعِدٍ ، وَأَنَا أَسْمَعُ ، حَدَّثَكُمُ ابْنُ زَنْجُوَيْهِ ، نَا مُحَمَّدُ بْنُ يُوسُفَ ، نَا سُفْيَانُ ، عَنْ أَبِي قَيْسٍ ، بِإِسْنَادِهِ مِثْلَهُ.
This narration is also transmitted with another chain of transmission.
Hadith 4100
قُرِئَ عَلَى ابْنِ عَبْدِ اللَّهِ بْنِ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ ، وَأَنَا أَسْمَعُ ، حَدَّثَكُمْ عَبْدُ الأَعْلَى بْنُ حَمَّادٍ ، نَا حَمَّادُ بْنُ سَلَمَةَ ، عَنِ الْحَجَّاجِ بْنِ أَرْطَأَةَ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ ثَرْوَانَ ، عَنِ الْهُزَيْلِ بْنِ شُرَحْبِيلَ ، أَنَّ أَبَا مُوسَى الأَشْعَرِيَّ ، سُئِلَ عَنْ رَجُلٍ تَرَكَ ابْنَةً ، وَابْنَةَ ابْنِهِ ، وَأُخْتَهُ لأَبِيهِ ، وَأُمَّهُ ، فَقَالَ : لِلابْنَةِ النِّصْفُ ، وَمَا بَقِيَ فَلِلأُخْتِ لِلأَبِ ، وَالأُمِّ ، وَقَالَ : إِنَّ ابْنَ مَسْعُودٍ ، سَيَقُولُ مثل مَا قُلْتُ ، فَسَأَلُوا ابْنَ مَسْعُودٍ ، وَأَخْبِرُوهُ بِمَا قَالَ أَبُو مُوسَى ، فَقَالَ ابْنُ مَسْعُودٍ : كَيْفَ أَقُولُ وَقَدْ سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " لِلابْنَةُ النِّصْفُ ، وَلابْنَةِ الابْنِ السُّدُسُ تَكْمِلَةُ الثُّلُثَيْنِ ، وَمَا بَقِيَ فَلِلأُخْتِ مِنَ الأَبِ ، وَالأُمِّ " .
Huzail bin Shurahbeel narrates that it was asked from Sayyiduna Abu Musa Ash'ari (may Allah be pleased with him) about a person who leaves behind a daughter, a granddaughter, and a full sister among his heirs. So Abu Musa said: "The daughter will receive half, and whatever remains will go to the sister." Then Abu Musa Ash'ari said: "Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) will also answer in accordance with what I have said." People then asked Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) about this, and also informed him of Abu Musa Ash'ari's answer. So Abdullah bin Mas'ud (may Allah be pleased with him) said: "How can I say this, when I have heard the Prophet (peace and blessings be upon him) say: (In such a situation) the daughter will get half, the granddaughter will get one-sixth, thus completing two-thirds, and whatever remains will go to the full sister."
Hadith 4100M
ثنا إِبْرَاهِيمُ بْنُ حَمَّادٍ ، أنا عَلِيُّ بْنُ حَرْبٍ ، نَا عَبْدُ الرَّحْمَنِ الْمُحَارِبِيُّ ، عَنْ مُحَمَّدِ بْنِ عَمْرٍو ، حَدَّثَنِي شَرِيكُ بْنُ عَبْدِ اللَّهِ بْنِ أَبِي نَمِرٍ ، قَالَ : سُئِلَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " عَنْ مِيرَاثِ الْعَمَّةِ وَالْخَالَةِ ، فَسَكَتَ وَهُوَ رَاكِبٌ فَسَارَ هُنَيْهَةً ، فَقَالَ : حَدَّثَنِي جَبْرَائِيلُ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ لا مِيرَاثَ لَهُمَا " وَكَذَلِكَ رَوَاهُ عَبْدُ الْوَهَّابِ الثَّقَفِيُّ ، وَغَيْرُهُ ، عَنْ مُحَمَّدِ بْنِ عَمْرٍو . وَرَوَاهُ مَسْعَدَةُ بْنُ الْيَسَعِ، عَنْ مُحَمَّدِ بْنِ عَمْرٍو ، عَنْ أَبِي سَلَمَةَ ، عَنْ أَبِي هُرَيْرَةَ ، وَوَهِمَ فِيهِ وَالأَوَّلُ أَصَحُّ ، وَحَدِيثُ مَسْعَدَةَ يَأْتِي بَعْدَ هَذَا وَوَهِمَ فِيهِ وَالأَوَّلُ أَصَحُّ ، وَحَدِيثُ مَسْعَدَةَ يَأْتِي بَعْدَ هَذَا.
Sayyiduna Abdullah bin Abu Numair (may Allah be pleased with him) reports that the Prophet Muhammad (peace and blessings be upon him) was asked about the inheritance of the paternal and maternal aunts. The Prophet (peace and blessings be upon him) remained silent; at that time, he was riding his mount and slowed its pace. Then the Prophet (peace and blessings be upon him) said: "Jibreel (Gabriel), peace be upon him, has informed me that neither of them will receive a share in inheritance." This narration is also transmitted through some other chains.
Hadith 4101
نَا مُحَمَّدُ بْنُ الْقَاسِمِ بْنِ زَكَرِيَّا ، نَا هِشَامُ بْنُ يُونُسَ ، نَا الدَّرَاوَرْدِيُّ ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ ، عَنْ أَبِيهِ ، " أَنَّ أُمَّ كُلْثُومٍ بِنْتَ عَلِيٍّ ، وَابْنَهَا زَيْدًا وَقَعَا فِي يَوْمٍ وَاحِدٍ ، وَالْتَقَتِ الصَّائِحَتَانِ ، فَلَمْ يُدْرَ أَيُّهُمَا هَلَكَ قَبْلُ ، فَلَمْ تَرِثْهُ وَلَمْ يَرِثْهَا ، وَأَنَّ أَهْلَ صِفِّينَ لَمْ يَتَوَارَثُوا ، وَأَنَّ أَهْلَ الْحَرَّةِ لَمْ يَتَوَارَثُوا " .
Jafar Sadiq narrates from his father (Muhammad Baqir): The daughter of Sayyiduna Ali, Umm Kulthum, and her son Zaid (who was the son of Sayyiduna Umar), both passed away on the same day, and the time of their deaths was very close to each other. It could not be determined which of them died first. Therefore, the woman did not inherit from the child, nor did the child inherit from the woman. Similarly, the people of Siffin did not inherit from each other, and likewise, those killed in the incident of Harrah did not inherit from each other.
Hadith 4102
حَدَّثَنَا إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ ، نَا عَبَّاسُ بْنُ مُحَمَّدٍ ، نَا يَحْيَى بْنُ أَبِي بُكَيْرٍ ، نَا أَبُو هَانِئٍ عُمَرُ بْنُ بَشِيرٍ ، قَالَ : سُئِلَ عَامِرٌ ، " عَنْ مَوْلُودٍ لَيْسَ بِذَكَرٍ وَلا أُنْثَى ، لَيْسَ لَهُ مَا لِلذَّكَرِ وَلَيْسَ لَهُ مَا لِلأُنْثَى يَخْرُجُ مِنْ سُرَّتِهِ كَهَيْئَةِ الْبَوْلِ وَالْغَائِطِ ، فَسُئِلَ عَامِرٌ عَنْ مِيرَاثِهِ ، فَقَالَ عَامِرٌ : نِصْفُ حَظِّ الذَّكَرِ ، وَنِصْفُ حَظِّ الأُنْثَى " .
Abu Hani Umar bin Bashir narrates: Sayyiduna Amir (may Allah be pleased with him) was asked about such a child who is neither male nor female, who has neither any sign of a man nor any sign of a woman, but urine or stool comes out from the place of the navel. Sayyiduna Amir (may Allah be pleased with him) was asked about the inheritance of such a child, so he said: "He will receive half of the share of a man and half of the share of a woman."
Hadith 4103
نَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، وَأَحْمَدُ بْنُ عَلِيِّ بْنِ الْعَلاءِ ، قَالا : نَا يُوسُفُ بْنُ مُوسَى ، نَا عَمْرُو بْنُ حُمْرَانَ ، عَنْ عَوْفٍ ، عَنْ سُلَيْمَانَ بْنِ جَابِرٍ الْهَجَرِيِّ ، قَالَ : قَالَ عَبْدُ اللَّهِ بْنُ مَسْعُودٍ : قَالَ لِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " تَعَلَّمُوا الْقُرْآنَ وَعَلِّمُوهُ النَّاسَ ، وَتَعَلَّمُوا الْفَرَائِضَ وَعَلِّمُوهَا النَّاسَ ، وَتَعَلَّمُوا الْعِلْمَ وَعَلِّمُوهُ النَّاسَ ، فَإِنِّي امْرِؤٌ مَقْبُوضٌ ، وَإِنَّ الْعِلْمَ سَيُقْبَضُ ، وَتَظْهَرُ الْفِتَنُ حَتَّى يَخْتَلِفَ الاثْنَانِ فِي الْفَرِيضَةِ لا يَجِدَانِ مَنْ يَفْصِلُ بَيْنَهُمَا " ، قَالَ لِي تَابَعَهُ جَمَاعَةٌ ، عَنْ عَوْفٍ ، وَرَوَاهُا الْمُثَنَّى بْنُ بَكْرٍ ، عَنْ عَوْفٍ ، عَنْ سُلَيْمَانَ بْنِ جَابِرٍ ، عَنْ أَبِي الأَحْوَصِ ، عَنْ عَبْدِ اللَّهِ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِهَذَا ، قَالَ : وَقَالَ الْفَضْلُ بْنُ دَلْهَمٍ ، عَنْ عَوْفٍ ، عَنْ شَهْرٍ ، عَنْ أَبِي هُرَيْرَةَ.
Sayyiduna Abdullah bin Mas’ud (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said to me: “Acquire the knowledge of the Qur’an and teach it to the people, acquire the knowledge of inheritance and teach it to the people, acquire knowledge and teach it to the people, for I will pass away and soon knowledge will also be taken away and tribulations will begin to appear, until there will be a dispute between two men regarding the share of inheritance, and they will not find anyone who can decide between them.” This narration is also transmitted through some other chains of transmission.
Hadith 4104
نَا جَعْفَرُ بْنُ مُحَمَّدِ بْنِ نُصَيْرٍ ، نَا مَحْمُودُ بْنُ مُحَمَّدٍ الْمَرْوَزِيُّ ، قَالَ : قَرَأْتُ عَلَى إِبْرَاهِيمَ بْنِ يُوسُفَ اللُّجِّيِّ ، نَا الْمُسَيِّبُ بْنُ شَرِيكٍ ، نَا زَكَرِيَّا بْنُ عَطِيَّةَ ، عَنْ أَبِي سَعِيدٍ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " تَعَلَّمُوا الْعِلْمَ وَعَلِّمُوهُ النَّاسَ ، وَتَعَلَّمُوا الْفَرَائِضَ وَعَلِّمُوهَا النَّاسَ ، وَتَعَلَّمُوا الْقُرْآنَ وَعَلِّمُوهُ النَّاسَ ، فَإِنِّي امْرِؤٌ مَقْبُوضٌ ، وَإِنَّ الْعِلْمَ سَيُقْبَضُ ، وَتَظْهَرُ الْفِتَنُ حَتَّى يَخْتَلِفُ الاثْنَانِ فِي فَرِيضَةٍ ، فَلا يَجِدَانِ أَحَدًا يَفْصِلُ بَيْنَهُمَا " .
Sayyiduna Abu Sa'id Khudri (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: "Acquire knowledge and teach it to the people, acquire the knowledge of inheritance and teach it to the people, acquire the knowledge of the Qur'an and teach it to the people. Soon I will pass away and soon knowledge will also be taken away, and tribulations will appear, to the extent that two men will differ regarding the shares of inheritance, and they will not find anyone who can decide between them."
Hadith 4105
نَا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ زَيْدِ الْجِنَانِيُّ ، نَا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ دَاوُدَ بْنِ أَبِي عَتَّابٍ ، نَا أَحْمَدُ بْنُ أَبِي الْعَبَّاسِ الرَّمْلِيُّ ، نَا ضَمْرَةُ ، عَنْ سَعِيدِ بْنِ الْحَسَنِ ، قَالَ : قُلْتُ لِسُفْيَانَ الثَّوْرِيِّ : " لَوْ وُلِّيتَ الْقَضَاءَ بِفَرَائِضِ مَنْ كُنْتَ تَأْخُذُ ؟ ، قَالَ : بِفَرَائِضِ زَيْدِ بْنِ ثَابِتٍ " .
Saeed bin Hasan narrates: I said to Sufyan Thawri, "If you take up the position of giving judgments regarding inheritance, from whom will you seek guidance in this matter?" Sufyan replied, "I will seek guidance from the decisions of Sayyiduna Zaid bin Thabit (may Allah be pleased with him) regarding inheritance."
Hadith 4106
نَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا بَحْرُ بْنُ نَصْرٍ ، نَا ابْنُ وَهْبٍ ، نَا إِسْحَاقُ بْنُ يَحْيَى بْنِ طَلْحَةَ التَّيْمِيُّ ، عَنِ الْمُسَيِّبِ بْنِ رَافِعٍ ، عَنِ الأَسْوَدِ بْنِ يَزِيدَ ، قَالَ : قَدِمَ عَلَيْنَا مُعَاذُ بْنُ جَبَلٍ حِينَ بَعَثَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " فَقَسَمَ فِينَا فَأَعْطَى الابْنَةَ النِّصْفَ ، وَالأُخْتَ النِّصْفَ ، وَلَمْ يُوَرِّثِ الْعَصَبَةَ شَيْئًا " .
Aswad bin Yazid narrates that Sayyiduna Mu'adh bin Jabal (may Allah be pleased with him) came to us, and this was at the time when the Noble Prophet (peace and blessings be upon him) had sent him. He distributed (inheritance) among us, so he gave the daughter half a share, the sister half a share, and did not give anything to the 'asaba (agnate) relatives.
