حَدَّثَنَا عَبْدُ الْغَافِرِ بْنُ سَلامَةَ ، نَا يَحْيَى بْنُ عُثْمَانَ ، نَا مُحَمَّدُ بْنُ حِمْيَرَ ، حَدَّثَنِي ثَوْرُ بْنُ يَزِيدَ ، عَنْ صَالِحِ بْنِ يَحْيَى بْنِ الْمِقْدَامِ ، أَنَّهُ سَمِعَ جَدَّهُ الْمِقْدَامَ ، يَقُولُ : أَقَمْتُ أَنَا وَبِضْعَةَ عَشَرَ رَجُلا مِنْ قَوْمِي يَوْمَيْنِ أَوْ ثَلاثَةً لَمْ نَذُقْ طَعَامًا ، وَقَدْ رَبَطُوا بُرْذُونَةً لِيَذْبَحُوهَا ، فَأَتَيْتُ خَالِدَ بْنَ الْوَلِيدِ فَأَعْلَمْتُهُ الَّذِي كَانَ مِنَّا فِي أَمْرِ الْبِرْذُونَةِ ، فَقَالَ : " لَوْ ذَبَحُوهَا لَسُؤْتُكَ ، ثُمَّ قَالَ : حَرَّمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَوْمَ خَيْبَرَ أَمْوَالَ الْمُعَاهَدِينَ ، وَحُمُرَ الإِنْسِ ، وَخَيْلَهَا وَبِغَالَهَا ، ثُمَّ أَمَرَ بِمُدَّيْنِ أَوْ مُدٍّ مِنْ طَعَامٍ " ، الشَّكُّ مِنْ يَحْيَى ، وَقَالَ : إِذَا أَتَتْنَا سَرِيَّةٌ فَاطَّلَعْنَا ، لَمْ يَذْكُرْ أَبَاهُ.
Yahya bin Maqdam narrates that he heard his grandfather saying: Once, I and ten or perhaps a few more people from my tribe had not eaten food for two or three days. They had tied a horse to slaughter it. I went to Sayyiduna Khalid bin Walid (may Allah be pleased with him) and informed him about our intention regarding the horse. So Sayyiduna Khalid bin Walid (may Allah be pleased with him) said: If those people had slaughtered it, they would have done wrong, because the Noble Prophet (peace and blessings be upon him) had, on the occasion of the Battle of Khaybar, declared the wealth of the dhimmis, and the meat of donkeys, horses, and mules to be unlawful. Then Sayyiduna Khalid (may Allah be pleased with him) ordered that those people be given two or perhaps one mudd of grain, and said that when we face any expedition, we will inform you.
