نَا نَا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ الْحَسَنِ الصَّوَّافُ ، نَا حَامِدُ بْنُ شُعَيْبٍ ، نَا سُرَيْجُ بْنُ يُونُسَ ، نَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ هُوَ أَبُو يُوسُفَ الْقَاضِي ، نَا هِشَامُ بْنُ عُرْوَةَ ، عَنْ أَبِيهِ ، أَنَّ عَبْدَ اللَّهِ بْنَ جَعْفَرٍ ، أَتَى الزُّبَيْرَ فَقَالَ : " إِنِّي اشْتَرَيْتُ بَيْعَ كَذَا وَكَذَا ، وَإِنَّ عَلِيًّا يُرِيدُ أَنْ يَأْتِيَ أَمِيرَ الْمُؤْمِنِينَ فَيَسْأَلَهُ أَنْ يَحْجُرَ عَلَيَّ فِيهِ ، فَقَالَ الزُّبَيْرُ : فَأَنَا شَرِيكُكَ فِي الْبَيْعِ ، فَأَتَى عَلِيُّ عُثْمَانَ ، فَقَالَ : إِنَّ ابْنَ جَعْفَرٍ اشْتَرَى بَيْعَ كَذَا وَكَذَا ، فَاحْجُرْ عَلَيْهِ ، فَقَالَ الزُّبَيْرُ : فَأَنَا شَرِيكُهُ فِي الْبَيْعِ ، فَقَالَ عُثْمَانُ : كَيْفَ أَحْجُرُ عَلَى رَجُلٍ فِي بَيْعٍ شَرِيكُهُ فِيهِ الزُّبَيْرُ ؟ " ، قَالَ يَعْقُوبُ : أنا آخُذُ بِالْحَجْرِ وَأُرَاهُ ، وَأَحْجُرُ ، وَأُبْطِلُ بَيْعَ الْمَحجُورِ عَلَيْهِ وَشِرَاهُ ، وَإِذَا اشْتَرَى أَوْ بَاعَ قَبْلَ الْحَجْرِ ، فَإِنْ كَانَ صَلاحًا أَجَزْتُهُ ، وَإِنْ كَانَ مَعْنًى يَسْتَحِقُّ الْحَجْرَ حَجَرْتُ عَلَيْهِ وَرَدَدْتُ عَلَيْهِ بَيْعَهُ ، وَإِنْ كَانَ مِمَّنْ لا يَسْتَحِقُّ الْحَجْرَ عَلَيْهِ أَجَزْتُ بَيْعَهُ . قَالَ يَعْقُوبُ بْنُ إِبْرَاهِيمَ : وَكَانَ أَبُو حَنِيفَةَ لا يَحْجُرُ وَلا يَأْخُذُ بِالْحَجْرِ.
Hisham bin Urwah narrates that Abdullah bin Ja'far came to Sayyiduna Zubair (may Allah be pleased with him) and said: I have bought such-and-such thing for such-and-such price, and now Sayyiduna Ali (may Allah be pleased with him) wants to go to the Commander of the Faithful and prevent me from disposing of it. So Sayyiduna Zubair (may Allah be pleased with him) said: I will become a partner with you in this transaction. Then he went to Sayyiduna Uthman (may Allah be pleased with him), and Sayyiduna Uthman (may Allah be pleased with him) said: The son of Ja'far has bought such-and-such thing for such-and-such price, and I am about to prevent him from disposing of it. So Sayyiduna Zubair (may Allah be pleased with him) said: I am also a partner with him in this transaction. Sayyiduna Uthman (may Allah be pleased with him) said: How can I prevent anyone from disposing of a transaction in which Sayyiduna Zubair (may Allah be pleased with him) is a partner? The narrator of this narration, Ya'qub, i.e., Qadi Abu Yusuf, says: My position is that in such a case, the concerned person can be prevented from disposing of it; I believe that I would prevent such a person and declare his transaction void, as long as he has been prevented from disposing of it, whether he has bought or sold something. But if something has been bought or sold before the person was prevented from disposing of it, then if it is in a correct state, I will declare it valid, but if there is any such situation in it due to which he deserves to be prevented from disposing of it, then I will prevent the concerned person from disposing of it and declare his transaction void. But if it is something in which it is not necessary to prevent disposal, I will declare his transaction valid. Qadi Abu Yusuf says: Imam Abu Hanifa neither used to prevent disposal nor did he give a fatwa regarding preventing disposal.
